Abstract
In this modern day improvement, especially in the business world, where there are competitions among the business owners, confidential information has become one of the main factors. Confidential information or trade secret is important and useful information in the field of technology and/or business that is not known by the public and has economic value. The scope of protection on Trade Secret shall include methods of production, methods of processing, methods of selling, or other information in the field of technology and/or business. Therefore, confidential information has been regulated in Law Number 30 Year 2000 regarding Trade Secret. However, the problem can arise between the owner and employee about trade secret. Trade secret is related with the agreement. The agreement between the employer and employee is made to protect the employer’s trade secret from the possibility of leaking by the employer.The main issue is whether the employee can disclose the trade secrets after the termination of the agreement. Despite the termination of the employee, he is expected to keep the trade secret as per employment agreement between the employee and the employer.In this thesis, will be discussed about protection of trade secret by the owner after the termination of agreement, breach of agreement by the employee and a case regarding trade secret and the settlement of the case / Di dunia modern yang berkembang sangat pesat, terutama di bidang bisnis, dimana banyak terjadi persaingan di antara sesame pemilik bisnis, informasi berharga menjadi salah satu faktor utama dan esensial. Informasi berharga atau rahasia dagang merupakan informasi yang penting dan sangat berguna dalam bidang teknologi dan/atau bisnis yang tidak diketahui oleh masyarakat. Ruang lingkup perlindungan hukum meliputi metode produksi, metode pengolahan, metode penjualan, atau informasi lain di bidang teknologi dan/atau bisnis. Peraturan informasi berharga ini diatur dalam UU No. 30 Tahun 2000 tentang Rahasia Dagang. . Meskipun demikian, banyak sekali permaslahan yang timbul antara pemilik rahasia dagang dengan pekerjanya dalam menjaga rahasia dagang. Rahasia dagang sangat erat kaitannya dengan perjanjian. Perjanjian ini dibuat oleh pemilik rahasia dagang dengan pekerja untuk mencegah terjadinya pembocoran rahasia dagang yang dilakukan oleh pekerjanya. Permasalahan utama dari penulisan ini adalah apakah pekerja diperbolehkan membocorkan rahasia dagang setelah berakhirnya perjanjian kerja. Tetapi demikian, banyak pihak yang berpendapat bahwa seharusnya pekerja tetap menjaga rahasia dagang tersebut. Dalam skripsi ini akan dibahas mengenai perlindungan terhadap rahasia dagang, pelanggaran serta contoh pelanggaran rahasia dagang dan cara menyelesaikannya.
