Land is a basic necessity in which humans execute daily activities. Throughout the years, demands for land increases along with rapid growth in infrastructure. This resulted in the implementation of land and property acquisition by the government. Although land ownership is protected by the human rights, land also possess social functions in which private ownership cannot deter social interests. In case decision no: 72/PDT.G/2013/PN.MDO, government housing was built on citizen-owned property. However, the government failed to pay the determined compensation in which the government unlawfully changed the amount, defying written legislations. Due to the absence of compensation in accordance to what has been agreed upon, there is also a lack of legal protection to the rightful land owner thus leading to great financial deprivation. The state should be able to provide legal protection to citizens as defined within the constitution. In addition, the state should regard and respect the rights of landowners, more so provide a fair and proper compensation in order to pursue a prosperous welfare and not the deterioration of it.
