Perseroan Terbatas merupakan salah satu bentuk dari Korporasi yang mempunyai kewajiban untuk menetapkan dan menyampaikan Pemilik Manfaat dari Perseroan Terbatas. Pemilik Manfaat dari Perseroan Terbatas merupakan orang perseorangan yang dapat menunjuk atau memberhentikan direksi, dewan komisaris, pengurus, pembina, atau pengawas pada Perseroan Terbatas, memiliki kemampuan untuk mengendalikan Perseroan Terbatas, berhak atas dan/atau menerima manfaat dari Perseroan Terbatas baik langsung maupun tidak langsung, merupakan pemilik sebenarnya dari dana atau saham Perseroan Terbatas dan/atau memenuhi kriteria sebagaimana dimaksud dalam Perpres 13 Tahun 2018. Penyampaian informasi Pemilik Manfaat dari Perseroan Terbatas dapat dilakukan oleh beberapa pihak, salah satunya adalah oleh Notaris dan dapat dilakukan melalui 2 (dua) cara yaitu melalui ahu.go.id atau Sistem Administrasi Badan Hukum (SABH). Terdapat perbedaan kedudukan Notaris pada saat penyampaian informasi Pemilik Manfaat dari Perseroan Terbatas yang dilakukan melalui ahu.go.id atau SABH, sehingga mengakibatkan perbedaan penerapan perlindungan hukum yang diterima oleh Notaris. / Limited Company is a form of corporation that has the obligation to determine and declare the Beneficial Owner of the Limited Company. The Beneficial Owner of the Limited Company is an individual who is able to appoint or remove directors, boards of commissioners, management, governing board, or supervisors of the Limited Company, have the ability to control the Limited Company, are entitled to and/or receive benefits from the Limited Company directly or indirectly, is the actual owner of the funds or shares of the Limited Company and/or meets the criteria as referred in Presidential Regulation No. 13 of 2018. Submission the Beneficial Owner information from the Limited Company can be done by several parties, one of which is by a Notary and can be done in 2 (two) ways namely through ahu.go.id and the Legal Entity Administration System (SABH). There are differences in the position of the Notary at the time of submitting the Beneficial Owner information from the Limited Company which is done through ahu.go.id or SABH, resulting in differences in the application of legal protection received by the Notary.
