Abstract

Tesis ini membahas mengenai penyalahgunaan wewenang. Hasil penelitian di lapangan pada saat masih banyak pejabat umum yaitu Notaris maupun PPAT yang dalam menjalankan tugas dan wewenangnya tidak sesuai dengan ketentuan sebagaimana diatur dalam Peraturan Undang-Undang terkait jabatan masing-masing, maupun sebagaimana diatur dalam kode etik jabatanya, yang mana sebagai seorang pejabat umum dalam melaksanakan jabatannya harus berpedoman terhadap ketentuan yang ada. Penelitian ini mengambil rumusan masalah mengenai kedudukan notaris yang menjabat sebagai PPAT dalam menjalankan salah satu jabatannya melakukan penyalahgunaan wewenang serta akibat hukum dan pertanggungjawaban atas keberpihakkan dalam membuat akta otentik. Apabila seorang Notaris maupun PPAT dalam melaksanakan jabatannya melakukan peyelewengan wewenang serta berpihak terhadap salah satu pihak sebagaimana dilarang didalam UUJN, PP No.37/1998, kode etik Notaris, kode etik PPAT maka akan mengakibatkan akta otentik yang dibuatnya menjadi batal demi hukum, serta Notaris maupun PPAT yang melanggar ketentuan tersebut akan mendapatkan sanksi baik yang antara lain sanksi administrasi dan sanksi hukum yang dapat berupa sanksi perdata maupun pidana. / This thesis discusses the abuse of authority. At this time there are still many general officials namely Notary and PPAT which carry out the authority duties not in accordance with the provisions stipulated in the Act of Law relating to each respective positions, or as stipulated in the code of ethics of the position, which as a general official in carrying out his position must be guided by existing provisions. The code of ethics of the position of the Notary and PPAT has been regulated in the Act of Law which as a general official in carrying out his position must be guided by the existing provisions. At this time there are still many general officials who do not comply with the provisions in carrying out their duties of authority. This research takes the formulation of the problem (The formulation of the problem to this research) regarding the position of notary who serves as PPAT in carrying out one of his positions is misusing authority and legal consequences and accountability for taking sides in making an authentic deed. If a notary public or PPAT in carrying out their positions violates authority and takes sides with one of the parties as prohibited in UUJN, PP No.37 / 1998, notary ethical code, PPAT ethical code, it will make the authentic deed that have been made null and void by law, and the Notary and PPAT who violate the provisions will get sanctions including administrative sanctions and legal sanctions which can be either civil or criminal sanctions
