Indonesia's economic development requires the enterpreneurs to grow businesses which demands substantial funds. In order to lend substantial amount of money, assurance is surely needed by funders to provide security and legal certainty in repayment of the debt or in the fullfilment of the agreement. Indonesian Regulation divides assurance into individual and material assurances. Fiduciary agreement that belongs to material assurance, is a transfer of an object's ownership rights on the basis of trust to the creditor, with provision that the object itself remains in the control of the owner of the object or the debtor. It is an accessory agreement of a primary agreement that creates obligations for the parties to fulfill their agreement. The examinations of this research are the responsibilities of debtor against destroyed fiduciary object and legal protection for both, debtors and creditors against destroyed fiduciary object, according to Undang-Undang No. 42 Year 1999.
