Abstract

Research on the Nature of Religious Freedom and Rights Beliefs, Law and Legal Practice: Christian Minority Group Studies in Indonesia in the 2007-2014 period, attracted the interest of researchers to be developed because there is an inconsistency between its arrangement and its manifestation and being one of the hottest issues in Indonesia. The Right to Freedom of Religion and Belief is a human right guaranteed by the Human Rights Declaration, the Convention on the Rights Civil and Political Affairs, as well as by the Constitution of the Republic of Indonesia (UUD 1945). Adherents to Christian minorities must have certainty that deep choose, adhere to and implement religious teachings and beliefs free from restrictions and discriminatory policies from the state. Which method used in this research is the library research method. Result research shows that: In the period 2007-2014, the right to freedom Christian minorities in Indonesia are threatened, making this group subordinated and discriminated against. Christian Minority Religious Groups in Indonesia is discriminated against due to discriminatory laws, the state is not serious in providing protection for Group Religious Freedom Minority Christianity and the violations were carried out in a systematic way through the formation of discriminatory regulations and partial trials. Violation of internal freedom and external freedom also occurs against Christian minority groups because of the weak role of the state to respect, protect and fulfill the rights of religious freedom of Christian minorities. This research emphasizes that in the future, the right to freedom Religion and belief are no longer regulated by positive law and must returned to its essence without modification and interference from the state. / Penelitian mengenai Hakekat Hak Kebebasan Beragama dan Berkeyakinan, Hukum dan Praktek Hukum: Studi Kelompok Minoritas Kristen di Indonesia Dalam Periode 2007-2014, menarik minat peneliti untuk dikembangkan karena terdapat inkonsistensi antara pengaturan dan perwujudannya serta menjadi salah satu isu yang paling hangat di Indonesia. Hak Kebebasan Beragama dan Berkeyakinan adalah hak asasi yang dijamin oleh deklarasi HAM, Konvensi Hak Sipil dan Politik, maupun oleh Konstitusi Republik Indonesia (UUD 1945). Penganut agama minoritas Kristen harus mendapat kepastian bahwa dalam memilih, menganut dan melaksanakan ajaran agama dan keyakinannya harus bebas dari pembatasan dan kebijakan diskriminatif dari negara. Metode yang digunakan dalam penelitian ini adalah metode penelitian kepustakaan. Hasil penelitian menunjukkan bahwa: Dalam periode 2007-2014, hak kebebasan beragama minoritas Kristen di Indonesia terancam, menjadikan kelompok ini tersubordinasi dan terdiskriminasi. Kelompok Agama Minoritas Kristen di Indonesia terdiskriminasi akibat hukum yang diskriminatif, negara tidak serius dalam memberikan perlindungan terhadap Kebebasan Beragama Kelompok Agama Kristen Minoritas serta pelanggaran itu dilakukan dengan cara sistematis melalui pembentukan aturan yang diskriminatif serta pengadilan yang parsial. Pelanggaran kebebasan internal dan kebebasan eksternal juga terjadi terhadap kelompok minoritas Kristen karena lemahnya peran negara untuk menghormati, melindungi dan memenuhi hak kebebasan beragama kelompok minoritas Kristen. Penelitian ini menekankan agar dimasa yang akan datang, hak kebebasan beragama dan berkeyakinan tidak diatur lagi oleh hukum positif dan harus dikembalikan ke esensinya tanpa modifikasi dan campur tangan dari negara.
