Abstract

Plot of land has high economic value, so do not be surprised if someone always tried to acquire plots of land in various ways either to dihaki or used as collateral for loans at the bank. By reason borrow certificates to be used as collateral in banks, land owners are invited facing the Land Deed Officer to sign the deed, and it was discovered that the deed was signed a deed of sale of land rights. Certificate is done behind the name and then used as loan collateral. Rights holders objected and eventually sued the cancellation of the deed of sale and claim compensation on the basis have committed acts against the law. Thesis with the approach of legislation and approach the concept gained a following conclusion: Deed of sale and purchase made before PPAT on buying and selling based fraud, remains valid. Agreement that accompanied the fraud committed by the purchaser, the seller who feel disadvantaged in suing the cancellation of the certificate of land rights, and filed for compensation on the basis of the buyer acts unlawful as article 1365 BW, because the buyer acts violate the right to wealth the seller as an act against the law. Deed of sale made before PPAT based on fraud does not affect the imposition of a security interest in Bank Danamon, because the deed of sale of land rights No.318 / 2010 which was made in the presence of Ny. Tuti Eltiati, SH, Notary / PPAT in Sleman, was conducted in accordance with the correct procedures and by the Supreme Court in its decision declared valid, then under the name of certificate of land rights to the name of the buyer, if the certificate of land rights is encumbered encumbrance by owner , granting a security interest made by deed granting a security interest by PPAT in accordance with applicable laws and undanganyang, in deed granting a security interest has listed the name and identity of the holder and giver of mortgage; domicile of the parties. / Bidang tanah mempunyai nilai ekonomi tinggi, sehingga tidak heran jika seseorang selalu berusaha untuk memperoleh bidang tanah dengan berbagai macam cara baik untuk dihaki maupun untuk dijadikan jaminan kredit di bank. Dengan alasan meminjam sertipikat untuk dijadikan jaminan di bank, pemilik hak atas tanah diajak menghadap Pejabat Pembuat Akta Tanah untuk menandatangani akta, dan baru diketahui bahwa akta yang ditandatangani adalah akta jual beli hak atas tanah. Sertipikat dilakukan balik nama dan kemudian dijadikan jaminan kredit. Pemegang hak merasa keberatan dan akhirnya menggugat pembatalan akta jual beli dan gugatan ganti kerugian atas dasar telah melakukan perbuatan melanggar hukum. Tesis dengan pendekatan peraturan perundang-undangan dan pendekatan konsep diperoleh suatu kesimpulan sebagai berikut: Akta jual beli yang dibuat di hadapan PPAT atas jual beli didasarkan penipuan, tetap sah. Adanya kesepakatan yang disertai dengan penipuan yang dilakukan oleh pembeli, pihak penjual yang merasa dirugikan dalam menggugat pembatalan sertipikat hak atas tanah, dan mengajukan gugatan ganti kerugian atas dasar pembeli melakukan perbuatan melanggar hukum sebagaimana pasal 1365 B.W., karena pembeli melakukan perbuatan melanggar hak atas harta kekayaan penjual sebagai suatu perbuatan melanggar hukum. Akta jual beli yang dibuat di hadapan PPAT didasarkan atas penipuan tersebut tidak mempengaruhi pembebanan hak tanggungan pada Bank Danamon, karena akta jual beli hak atas tanah No.318/2010 yang dibuat di hadapan Ny. Tuti Eltiati, SH, Notaris/PPAT di Sleman, tersebut dilakukan sesuai dengan prosedur yang benar dan oleh Mahkamah Agung dalam putusannya dinyatakan sah, maka dengan balik nama sertipikat hak atas tanah menjadi nama pembeli, jika sertipikat hak atas tanah tersebut dibebani hak tanggungan oleh pemiliknya, pemberian hak tanggungan dilakukan dengan pembuatan akta pemberian hak tanggungan oleh PPAT sesuai dengan peraturan perundang-undanganyang berlaku, di dalam akta pemberian hak tanggungan telah tercantum nama dan identitas pemegang dan pemberi hak tanggungan; domisili pihak-pihak.
