Abstract

Kementerian ATR/BPN melakukan perombakan layanan hak tanggungan dengan menerbitkan Peraturan Menteri ATR/BPN Nomor 5 Tahun 2020, yang mana pelayanan pendaftaran hak tanggungan yang dulunya dilakukan secara manual menjadi layanan hak tanggungan berbasis elektronik. Fokus penelitian ini adalah pada pendaftaran hak tanggungan elektronik memberikan perubahan cara penyampaian dokumen pendaftaran hak tanggungan termasuk bagaimana memastikan keabsahan dokumen elektronik dan juga penyimpanan asli lembar kedua APHT yang disampaikan secara elektronik. Penelitian ini adalah jenis penelitian yuridis normatif, yang menggunakan pendekatan perundang-undangan dan konseptual, serta menggunakan data sekunder sebagai dasar penelitian atas rumusan masalah. Hasil penelitian ini menyimpulkan bahwa dalam hal PPAT terlambat mendaftarkan APHT dalam sistem HT-el dan/atau terlambat dalam melakukan perbaikan kesalahan data dalam sertifikat HT-el sebagaimana ketentuan dalam UU Hak Tanggungan dan Permen ATR/KBPN No. 5/2020 dapat memberikan akibat hukum dimana hak tanggungan tidak terdaftar sehingga kedudukan kreditur tetap menjadi kreditur konkuran dan tidak memiliki hak untuk didahulukan pembayarannya. Selain itu, Permen ATR/KBPN No. 5/2020 memberikan dua amanah baru kepada PPAT yaitu PPAT bertanggung jawab atas keabsahan dokumen yang dunggah dalam sistem elektronik dan PPAT bertanggung jawab untuk melakukan penyimpanan asli lembar kedua APHT dan warkah pendukung di kantor PPAT./ The Ministry of Agrarian Affairs and Spatial/Planning/ National Land Agency (ATR/BPN) made a revamping land mortgage services by issuing Ministerial Regulation of ATR/BPN Number 5 of 2020, whereas the mortgage registration service which was previously done manually into an electronic-based mortgage service (HT-el). The focus of this research is on the submission of mortgage registration documents, including how to ensure the validity of such electronic documents and the storage of the original second sheet of APHT. This is legal research which use the normative method of legal study, it uses the statue and conceptual approach, and seconder data as the basis data. As the result of this research, it is concluded that in the event that PPAT is late in registering APHT in the HT-el system and/or late in correcting data errors in the HT-el certificate as stipulated in the Mortgage Law and Ministerial Regulation of ATR/KBPN No. 5/2020, it can provide legal consequences where mortgage rights are not registered, therefore the creditor's position remains as a concurrent creditor and does not have the preference right of their payments. In addition, Ministerial Regulation of ATR/KBPN No. 5/2020 provides two new mandates to PPAT, in which PPAT is responsible to ensure the validity of the documents uploaded in the system HT-el and PPAT is also responsible to keep the original of the second sheet of APHT and another supporting documents at PPAT Office as warkah.
