Abstract

Indonesia sebagai salah satu negara berkembang membuat para investor asing berkeinginan tinggal di Indonesia dan memiliki tanah di Indonesia namun terdapat keterbatasan kepemilikan Hak atas Tanah oleh Warga Negara Asing yang mana diatur dalam Perundang-undangan, sehingga timbul beberapa penyimpangan untuk mendapat hak atas tanah oleh Warga Negara Asing di Indonesia, seperti yang terjadi dalam putusan nomor 1540 K/Pdt/2014. Penelitian ini merupakan penelitian normatif yang menggunakan pendekatan Perundang-undangan yaitu menggunakan peraturan yang ada untuk menganalisa putusan nomor 1540 K/Pdt/2014. Berdasarkan hasil dari penelitian maka dapat disimpulkan Perjanjian Pengikatan Jual Beli yang dilakukan dalam putusan tersebut merupakan perjanjian yang sah menurut Kitab Undang-Undang Hukum Perdata namun tidak dapat dijadikan sebagai bukti beralihnya atau berpindahnya Hak atas Tanah./Indonesia as a developing country who makes foreign investors want to live in Indonesia and have land in Indonesia. Foreign citizens have limited of the ownership of land which are regulated in legislation in Indonesia, and it is be some irregularities for foreign citizens to own land In Indonesia, such happen in decision number 1540 K / Pdt / 2014. This research is a normative study that uses a statutory approach, it can be used to analyze the decision number 1540 K / Pdt / 2014. Based on the results of the research, it can be concluded that the Binding Sale Agreement is a legal agreement according to the Civil Code but cannot be used as proof of ownership of land.
