Abstract

It has been known long that there is a pre-nuptial agreement before marriage, as of according to the Indonesian Civil Code (Kitab Undang-undang Hukum Perdata), and after the marriage itself as of according to the Decree (Decision) of the Constitutional Court No. 69/PUU-XIII Year 2015. The problem being discussed in this research is about how the regulation to regulate the Indonesian nationality who conduct the mixed marriage for the title of land of Freehold and title of land Right To Build after the decision or the Decree of the Constitutional Court No. 69/PUU-XIII Year 2015, and the role of Notary in regards to the Deed of the (Pre) Nuptial/Marital Agreement. The research methodology being used is the normative approach, with analysis stressed on the prevailing regulations, legal cases, opinion of experts, and relevant legal theories to the issue of the research being conducted. The result of the research, is the Decree (Decision) of the Constitutional Court No. 69/PUU-XIII Year 2015 that is final and binding, meaning all parties and especially Notaries must respect and implement this decision regarding the marital agreement within marriages or after the marriage being hold, and shall be verified by the marriage registry official or notary. Marital Agreement that manages the self-ownership of assets will have positive impact for couples of mixed marriages, which enable an Indonesian nationality who marries foreigner, to not losing its rights of Freehold land title and Right to Build land title, with transfer of rights with means of sale and purchase activities, grants, and wills. For Notary to implement its role in accordance to their authority, may compile this required marital agreement before and within marriages, but this marital agreement within marriages, any amendments and annulments shall not cause any lost or harms to third parties. Hence, the writer is in the opinion that there is a need of further revision regarding the Law No 1 Year 1974 in regards to Marriages and also the implementing laws or regulations, which is the government regulation that is regulating in regards to the implementation of marital agreement, and it is being hoped for all government institutions to facilitate the process of transfer of rights of land titles of Freehold and Rights To Builds for those of mixed marriages. / Sudah sejak lama dalam perkawinan dikenal Perjanjian Perkawinan sebelum perkawinan dilaksanakan yang mana tercantum pada Kitab Undang-Undang Hukum perdata dan setelah perkawinan dilakukan ada dalam putusan Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII Tahun 2015. Rumusan masalah yang dibahas dalam penelitian ini adalah mengenai bagaimana pengaturan bagi Warga Negara Indonesia yang melakukan Perkawinan Campuran memperoleh tanah Hak Milik dan tanah Hak Guna Bangunan pasca Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII Tahun 2015 dan Peranan Notaris dalam pembuatan Perjanjian Perkawinan. Penelitian ini menggunakan metode pendekatan normatif, yaitu dengan menganalisa peraturan perundang-undangan, kasus-kasus hukum, pendapat ahli dan teori hukum yang relevan dengan isu penelitian yang diteliti. Hasil dari penelitian ini adalah Putusan MK tersebut bersifat final dan mengikat, artinya semua pihak terutama notaris harus menghormati dan melaksanakan Putusan MK Nomor 69/PUU-XIII/2015 tentang Perjanjian Perkawinan yang dibuat oleh para pihak dapat dibuat setelah perkawinan berlangsung dan harus disahkan oleh pejabat pencatat perkawinan yang berwenang atau notaris. Perjanjian Perkawinan yang mengatur mengenai pisah harta berdampak positif terutama bagi pelaku perkawinan campuran sehingga WNI yang menikah dengan WNA tidak akan kehilangan haknya sebagai warga negara untuk mempunyai hak kepemilikan dengan status Hak Milik dan Hak Guna Bangunan baik dengan peralihan secara jual beli, hibah dan wasiat. Notaris dalam menjalankan peranannya sesuai dengan kewenangannya dapat membuat perjanjian perkawinan sebelum dan semasa perkawinan berlangsung tetapi dalam pembuatan perjanjian perkawinan selama dalam ikatan perkawinan, perubahan Perjanjian Perkawinan dan pencabutan Perjanjian Perkawinan tidak boleh mengakibatkan kerugian bagi pihak ketiga. Oleh karena itu Penulis menilai bahwa perlunya diadakan revisi Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan legislasi pelaksana yaitu Peraturan Pemerintah yang mengatur mengenai pelaksanaan Perjanjian Perkawinan dan diharapkan bagi seluruh instansi pemerintahan untuk mempermudah proses peralihan Hak atas tanah dengan status Hak Milik dan Hak Guna Bangunan khususnya bagi pelaku Perkawinan Campuran.
