Abstract

In order to enforce compliance in relation to land, specifically regarding the authority who makes sale and purchase deed (AJB) related to the land, the government is assisted by Land Deed Official (PPAT). PPAT is the Land Deed Official whose authority is set in the law principal of agricultural and Govemnment Regulation 10/1961 Jo. Govemnment Regulation 24/1997 Jo Govemnment Regulation 37/1998. As a land deed official, everything that is related to the transfer deed of land, the giving of new land title deeds, and the binding contract of land as a guarantee debt, is the duties and presponsibilities of the Land Deed Officials and must be made before him. The problem formulated in this thesis are: (1) how is the responsibility of PPAT who ask his or her employee to add another name as a buyer in the AJB that has been signed by buyer and seller without valid documentation? And (2) what are the legal considerations and the judge's decision in the case of canceled sale and purchase deed of No. 2/2004 that was made by and before PPAT? This research is a normative study that uses a legislative approach, a case approach as well as a conceptual approach. There are two results in this study. First, when making a deed, PPAT must be catious and thorough. Besides, the deed must also be in accordance with the existing laws and regulations. If the regulations are broken, PPAT can be subjected to criminal, civil and administrative sanctions. Second, in its legal considerations, the Supreme Court Judges declared that the AJB No. 2/2004 no longer had binding legal force, due to the AJB being made before the parties paid PPH and BPHTB, this is in contrast to Law Number 20 year 2000. / Guna menciptakan ketertiban di bidang pertanahan khususnya menyangkut pejabat yang berwenang membuat Akta Jual Beli (AJB) mengenai tanah, pemerintah dibantu oleh Pejabat Pembuat Akta Tanah (PPAT). PPAT adalah Pejabat Pembuat Akta Tanah yang kewenangannya diatur dalam Undang-Undang Pokok Agraria dan PP 10/1961 jo. PP 24/1997 jo PP No. 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah. Sebagai pejabat pertanahan, segala hal yang berkenaan dengan akta-akta peralihan hak atas tanah, pemberian hak barn atas tanah, dan pengikatan tanah sebagai jaminan hutang, merupakan tugas dan tanggung jawab PPAT serta harus dibuat di hadapannya. Adapun permasalahannya adalah Bagaimana tanggung jawab hukum PPAT yang menyuruh pegawainya menambahankan satu nama orang lain sebagai pihak pembeli di dalam AJB yang sudah ditandatangani pihak pembeli dan pihak penjual tanpa dokumen yang sah? dan Bagaimana pertimbangan hukum dan putusan Hakim Agung dalam perkara Akta Jual Beli Nomor 2/2004 yang dibuat oleh dan dihadapan PPAT yang dibatalkan? Peneltian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan, pendekatan kasus dan pendekatan konseptual. Hasil penelitian menunjukkan pertama, bahwa dalam membuat suatu akta, seorang PPAT haruslah bersikap hati-hati dan teliti dan juga harus sesuai dengan peraturan perundang-undangan yang ada. Apabila tidak dilakukan, maka PPAT tersebut dapat dikenakan sanksi pidana, perdata maupun administratif. Kedua, dalam pertimbangan hukumnya, Majelis Hakim Mahkamah Agung menyatakan bahwa Akta Jual Beli Nomor 2/2004 tidak lagi memiliki kekuatan hukum yang mengikat, hal ini dikarenakan AJB tersebut dibuat sebelum para pihak membayarkan PPH dan BPHTB, hal ini bertentangan dengan Undang-Undang Nomor 20 Tahun 2000.
