Abstract

Perkembangan teknologi informasi saat ini telah membawa berbagai dampak dalam kehidupan masyarakat, termasuk Notaris. Notaris sebagai pejabat umum yang berwenang membuat akta autentik memiliki sejumlah kewajiban yang diatur dalam Pasal 16 Undang-Undang Jabatan Notaris. Salah satu bentuk kewajiban Notaris adalah membacakan akta dihadapan penghadap. Kehadiran penghadap sangat penting dalam pembuatan akta Notaris. Namun Undang-Undang Jabatan Notaris belum mengatur kehadiran penghadap melalui media elektronik sebagai bentuk kehadiran yang sah dalam pembuatan akta. Untuk melihat efektivitas pengaturan Undang-Undang Jabatan Notaris, diperlukan penelitian mengenai pelaksanaan ketentuan yang mewajibkan pembacaan akta Notaris melalui media elektronik. Penelitian ini menggunakan pendekatan perundang-undangan dan pendekatan kasus dengan wawancara langsung kepada Notaris guna memperoleh pendapat terkait pelaksanan pembacaan akta Notaris melalui media elektronik. Dari hasil penelitian tersebut, dapat disimpulkan bahwa pembacaan akta Notaris melalui media elektronik belum dapat dilaksanakan karena hal tersebut belum diatur dalam Undang-Undang Jabatan Notaris / Technological and information advancement was brought various of fundamental changes to people’s life, including Notaries. As officials, Notaries are authorized to make authentic deeds as amount of obligated according Article 16 of the Law of Notary Profession. Notaries among others are obligated to read the authentic deeds in front of involved parties. The presence of involved parties is very important in making a Notary deed. However, the law for Notary’s position does not yet regulate the presence of involved parties with digital means as an effective legal presence. To see the effectiveness of the regulation dedicated research is needed to cover the digital usage in reading Notary deeds. This study uses a statutory and case study approach by directly interviewing notaries to obtain necessary opinion regarding the implementation of reading notary deeds with digital means. The results of this research are it can be concluded that reading notary deeds with digital means can not be carried out as it not yet regulated in the law for Notary’s position
