Abstract

Notaris sebagai pejabat umum berwenang untuk membuat akta otentik atas suatu perbuatan hukum yang diatur berdasarkan ketentuan peraturan perundang-undangan yang berlaku. Selain membuat akta otentik, notaris juga memiliki tanggung jawab untuk menyimpan dan memelihara protokol notaris lainnya apabila ditunjuk oleh Majelis Pengawas Daerah sebagai notaris pemegang protokol tersebut. Namun yang sering terjadi pada notaris pemegang protokol yaitu mendapatkan gugatan dari pihak ketiga terkait dengan kesalahan dalam akta pada protokol notaris yang dipegang oleh notaris pemegang protokol. Rumusan masalah dalam penelitian ini, yang pertama adalah mengenai sejauh mana tanggung jawab notaris pemegang protokol dalam menjalankan tugasnya adalah memegang protokol notaris lain. Kemudian yang kedua adalah bagaimana peran Majelis Pengawas Daerah terkait gugatan terhadap notaris pemegang protokol dari pihak ketiga, mengingat pengangkatan notaris pemegang protokol merupakan kewenangan Dewan Pengawas Daerah. Penelitian ini merupakan jenis penelitian Yuridis Normatif, yang menggunakan pendekatan perundang-undangan dan pendekatan konseptual, serta menggunakan teknik pengumpulan data dengan studi dokumen dan wawancara. Terkait dengan kesimpulan atas rumusan masalah pada penelitian ini yaitu tanggung jawab seorang notaris pemegang protokol hanya sebatas menyimpan serta merawat protokol notaris yang dipegang, dan yang menjadi peran dari Majelis Pengawas Daerah adalah melindungi serta membina notaris pemegang protokol apabila notaris tersebut digugat oleh pihak ketiga. / A notary as a public official has the authority to make an authentic deed of a legal act that is regulated based on the provisions of the applicable legislation. In addition to making an authentic deed, a notary also has a responsibility to store and maintain the protocol of the notary and other notaries if appointed by the Regional Supervisory Council as the notary holding the protocol. However, it often happens to the notary as the holder of the protocol, namely to get a lawsuit from a third party related to the error of the deed held by the notary holding the protocol. So the first problem formulation in this thesis is regarding the extent to which the responsibilities of the protocol holder notary in carrying out their duties are holding the protocol of another notary. Then the second is how the role of the Regional Supervisory Council is related to the lawsuit against the notary holding the protocol from a third party, considering that the appointment of the notary holding the protocol is the authority of the Regional Supervisory Council.This research is a type of normative juridical research, which uses a statutory approach and a conceptual approach, and uses data collection techniques with document studies and interviews. Related to the conclusion on the formulation of the problem in this study, the responsibility of a notary holding a protocol is only limited to storing and maintaining a notary protocol held, and the role of the Regional Supervisory Council is to protect and foster a notary holding a protocol if the notary is sued by a third party.
