Abstract

Main authorities of Notary is making an authentic deeds, pursuant to Article 1870 and Article 1871 of Indonesia Civil Code states that the authentic deeds is perfect evidence for the party and beneficiaries, including the people who will get the right as contained on the deed. The purpose of make a deed is if there is a dispute between of the parties or a claim from another party can be used as a strong evidence. Authentic deeds in essence contain the formal truths in accordance with the provisions given by the party to the Notary. Notary as a public official is required to be responsible for authentic deeds that have been made, such as if the authentic deed is made before occurs of the date the legal dispute, if the authentic deed is contained the legal errors, either due to the error by Notary or its negligence, and its deliberateness, thus the Notary shall take the responsibility for his actions due to made the authentic deeds. In the event of an unlawful act, the Notary as a public official can be held accountable based on the nature of the violation and the legal consequences caused. The responsibilities by the Notary it can be form of the criminal, administrative and civil liability. In order to making the testatement have the requirements shall be fulfill by the beneficiaries, ie aged 18 years and have a healthy mind and if the requirements have not fulfill. Whether the form of the unlawful act conduct by the Notary due to made the testament on the Verdict Number 3124 K/PDT/2013? Legal consenquences of the authentic deeds which made by the Notary with the unlawful act, thus the position of the deed is become the private deed. If the objective requirements are not fulfilled, thus the deed becomes null and void by law and if the subjective requirements are not fulfilled, thus can request for the cancellation. / Wewenang utama notaris adalah membuat akta otentik, berdasarkan Pasal 1870 dan 1871 KUHPerdata dikemukakan bahwa, akta otentik itu adalah alat pembuktian yang sempuma bagi kedua belah pihak dan ahli warisnya serta sekalian orang yang mendapat hak darinya tentang apa yang dimuat dalam akta tersebut. Tujuan pembuatan akta adalah agar akta tersebut dapat digunakan sebagai bukti yang kuat, jika suatu saat terjadi pprselisihan antara para pihak atau ada gugatan dari pihak lain. Akta otentik pada hakikatnya memuat kebenaran formal sesuai dengan apa yang diberitahukan para pihak kepada Notaris. Notaris sebagai pejabat umum dituntut untuk bertanggungjawab terhadap akta otentik yang telah dibuatnya, jika akta autentik yang dibuatnya dibelakang hari terjadi sengketa hukum, Jika akta autentik notaris yang telah dikeluarkan mengandung cacat hukum, baik karena kesalahan notaris maupun kelalaiannya, serta kesengajaan notaris itu sendiri maka notaris harus mempertanggungjawabkan perbuatannya dalam membuat akta otentik. Dalam hal teijadi perbuatan melawan hukum, maka Notaris sebagai pejabat umum dapat dimintakan pertanggungjawabannya berdasarkan sifat pelanggaran dan akibat hukum yang ditimbulkannya Pertanggungjawaban yang biasa dikenakan terhadap Notaris adalah pertanggungjawaban pidana, administrasi dan perdata. Dalam pembuatan akta wasiat terdapat syarat yang harus dipenuhi oleh pewaris, berusia minimal 18 tahun dan akal budi yang sehat Dan ketika syarat tersebut tidak terpenuhi , apa yang dilakukan Notaris dengan tetap membuat akta wasiat menjadi sebuah perbutan melawan hukum seperti yang terjadi dalam putusan Perkara No. 3124 K/Pdt/2013. Akibat hukum dari akta yangdibuat oleh Notaris memenuhi unsur perbuatan melawan hukum, maka kedudukan akta tersebut menjadi akta dibawah tangan. Bila syarat obyektik yang tidak dipenuhi maka akat tersebut menjadi batal demi hukum dan bila syarat subyektif yang tidak terpenuhi maka dapat dimohonkan untuk pembatalan.
