Abstract

Perkembangan teknologi membuat segala sesuatu menjadi mudah, cepat dan efisien. Salah satu aspek yang terdampak dari kemajuan teknologi yang begitu pesat adalah sektor perdagangan melalui sistem elektronik (e-commerce). Jual beli yang dilakukan antara penjual dan pembeli yang semula harus dilakukan secara tatap muka, kini dimungkinkan untuk dilakukan secara daring melalui berbagai platform dan marketplace. Namun demikian, dari segudang manfaat yang ada dengan hadirnya teknologi dan perkembangannya, tidak dapat dipungkiri bahwa terdapat berbagai risiko yang timbul, salah satunya adalah risiko terhadap privasi dan keamanan data. Berbagai kasus kebocoran yang terjadi, mulai dari kasus bocornya data Tokopedia hingga bocornya data Presiden Joko Widodo ke dunia siber dan kurang ketatnya penegakan hukum dan penindakan terhadap kasus-kasus tersebut menunjukkan bahwa hukum positif yang mengatur tentang perlindungan data pribadi di Indonesia masih belum memadai, ada kekosongan hukum atau tidak adanya payung hukum yang menjadi acuan tunggal dalam penegakannya serta kurang diprioritaskannya perlindungan terhadap data pribadi yang mana hal tersebut adalah salah satu bentuk hak privasi yang notabene adalah hak dasar manusia. Penelitian dalam tesis ini adalah tentang kewajiban dan tanggung jawab penyelenggara sistem elektronik dalam kapasitasnya sebagai pengendali dan/atau prosesor data pribadi dengan melakukan analisis komparatif antara pengaturan hukum positif yang ada di Indonesia, pengaturan internasional yang berlaku, pengaturan domestik di beberapa negara Asia, serta RUU PDP Indonesia yang tengah digodok pembahasannya di DPR. Hasil penelitian menunjukkan bahwa ketentuan dalam hukum positif yang mengatur tentang kewajiban dan tanggung jawab penyelenggara sistem elektronik dalam kapasitasnya sebagai pengendali dan/atau prosesor data pribadi masih sangat kurang dan belum ada payung hukum di Indonesia tentang perlindungan data pribadi seperti EU GDPR (golden rule). Oleh karena itu, urgensi untuk pengesahan RUU PDP semakin meningkat dan harus menjadi prioritas utama sebagai bentuk penghormatan terhadap hak asasi manusia./Development in technology has made everything extremely convenient, fast and efficient. One of the aspects affected by such rapid technological developments is the e-commerce sector. The past practice of trade requires the direct face-to-face interaction between a seller and a buyer, whereas the current practice of online trade is made possible through the utilization of online platforms and marketplaces. However, regardless of the abundance of benefits derived from the existence of technology and its developments, it is inevitable that various new risks have also been emerging, one of which is the risk of data privacy and security. There have been a number of data breach cases, from the Tokopedia case to the leakage of President Joko Widodo’s identification number in the cyber space. The unideal results of law enforcement and case handling on data breach cases indicate that the existing regulations on personal data prortection in Indonesia are inadequate, and that they are also caused by the absence of a single comprehensive regulatory framework on personal data protection and that personal data protection has not been the top priority whereas privacy rights are a form of fundamental rights of a human being. The research in this thesis is regarding the obligations and responsibilities of electronic system providers in their capacity as personal data controllers and/or processors by way of comparative analysis between the existing regulations in Indonesia, applicable international regulations, domestic regulations of certain Asian countries, and the Personal Data Protection Bill (the PDP Bill) which is currently still undergoing discussion by the House of Representatives. The result of this research indicates that the existing regulations covering provisions on the obligations and responsibilities of electronic system providers in their capacity as personal data controllers and/or processors are extremely inadequate and there is absence of a single legal framework in Indonesia on personal data protection like the EU GDPR (golden rule). Therefore, it increases the urgency of the passing of the PDP Bill and that this matter should become the top priority as a form of respect for human rights.
