Abstract

Asas Cabotage adalah asas yang mengatur bahwa hanya kapal berbendera Indonesia dan Awak Kapal yang berkewarganegaraan Indonesia yang dapat berlayar di Indonesia, yang mana asas ini diatur dalam Pasal 8 Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran dengan ketentuan dalam Peraturan Menteri Perhubungan Nomor PM 2 Tahun 2021 tentang PM 2 Tahun 2021 Tentang Tata Cara Dan Persyaratan Pemberian Persetujuan Penggunaan Kapal Asing Untuk Kegiatan Lain Di Wilayah Perairan Indonesia Yang Tidak Termasuk Kegiatan Mengangkut Penumpang Dan Barang. Berdasarkan hasil penelitian ditemukan bahwa implementasi Asas Cabotage memberikan pengaruh yang besar terhadap industri pelayaran nasional dan membuktikan bahwa menjadi semakin berkembang. Jumlah perusahaan pelayaran nasional dan kapal nasional semakin bertambah dari tahun ke tahun. Selain itu, jumlah pengangguran berkurang sehingga hal tersebut merupakan faktor yang menguntungkan untuk kemakmuran rakyat. Dalam penelitian ini melihat dari kenyataan atau data yang ada dalam praktik yang selanjutnya dihubungkan dengan ketentuan hukum yang berlaku dan juga pendekatan kasus, yaitu dengan metode wawancara langsung dengan salah satu pengurus Indonesian National Shipowners’ Association (INSA) tentang pengaruh dari Asas Cabotage dan ketentuan yang berkaitan dengan asas itu. Dari penelitian tersebut dapat disimpulkan bahwa ada ketentuan yang masih memperbolehkan Kapal Asing yang masuk ke Indonesia dengan syarat. / The Cabotage principle is a principle that stipulates that only Indonesian-flagged vessels and Indonesian crew members can sail in Indonesia, which is regulated in Article 8 of Law Number 17 of 2008 concerning Shipping with the provisions of the Regulation of the Minister of Transportation Number PM 2 of 2021 concerning Procedures and Requirements for Granting Approval for the Use of Foreign Ships for Other Activities Not Including Activities of Transporting Passengers and/or Goods in Domestic Sea Transportation Activities. Based on the results of the study, it was found that the implementation of the Cabotage Principle had a great influence on the national shipping industry and proved that it was growing. The number of national shipping companies and national ships is increasing from year to year. In addition, the number of unemployed is reduced so that it is a favorable factor for the prosperity of the people. In this study, we look at the facts or data that exist in practice which are then linked to the applicable legal provisions and also the case approach, namely by using a direct interview method with one of the administrators of the Indonesian National Shipowners' Association (INSA) about the influence of the Cabotage Principle and the provisions contained in this study. related to that principle. From this research, it can be concluded that there are provisions that still allow foreign ships to enter Indonesia with conditional.
