Abstract

Pengaturan Eksekusi Hak Tanggungan melalui parate eksekusi, title eksekutorial dan eksekusi dibawah tangan diatur dalam Pasal 6, Pasal 20 dan Pasal 21 Undang-Undang Hak Tanggungan Nomor 4 Tahun 1996 Tentang Hak Tanggungan Atas Tanah Berserta Benda-Benda Yang Berkaitan Dengan Tanah. Sejak terbitnya Peraturan Menteri Agraria Nomor 5 Tahun 2020 Tentang Pelayanan Hak Tanggungan Terintegrasi secara elektronik mengakibatkan beralihnya proses pendaftaran Hak Tanggungan yang sebelumnya secara manual menjadi berbasis elektronik. Tujuan dokumen elektronik untuk efisiensi waktu dalam hal pengurusan dan mempermudah pengguna Hak Tanggungan dalam proses pendaftaran Hak Tanggungan. Pendaftaran Hak Tanggungan dan Eksekusi Hak Tanggungan merupakan 2 (dua) hal yang tidak dapat dipisahkan, dengan terbitnya peraturan baru ini tentunya perlu ada penyesuaian dalam proses eksekusi Hak Tanggungan, kendala yang dihadapi sejak terbitnya peraturan ini adalah belum seluruh data objek tanah update dalam sistem database Badan Pertanahan Nasional mengakibatkan sistem menjadi sering eror, sebelum dan setelah terbit dokumen berbasis elektronik kendala yang dihadapi adalah adanya upaya hukum yang dilakukan oleh debitur, pengosongan, sertipikat hak atas tanah yang menjadi objek Hak Tanggungan yang tidak sesuai peruntukannya sebagaimana diatur dalam Undang Undang Pokok Agraria./The Execution of Mortgage Rights arrangement through parate, title, and underhand execution is stipulated in Article 6, Article 20, and Article 21 of Act No. 4 of 1996 concerning the Land Right of Mortgage and Land-Related Objects. The Minister of Agrarian Affairs Regulation No. 5 of 2020 concerning Electronic Integrated Mortgage Rights Services resulted in switching the manual to the electronic-based registration process. The electronic documents aim to ease mortgage rights registration and time management efficiency. Registration and Execution of Mortgage Rights are essential. The issuance of the regulation requires adjustments in the execution process of Mortgage Rights. The data are not updated in the National Land Agency database, which resulted in the error system issuing electronic documents. The obstacles encountered are legal efforts carried out by debtors and land clearing. The certificates of land rights of Mortgage Rights are not following the designation as stipulated in the Basic Agrarian Principles.
