Abstract

Perjanjian pengikatan jual beli rumah dan/atau satuan rumah susun merupakan suatu produk hukum yang dibuat oleh Notaris dengan tujuan menimbulkan kesepakatan antara developer dengan calon pembeli dalam melakukan jual beli rumah dan/atau satuan rumah susun, yang dapat dilakukan oleh developer sebelum pembangunan dimulai atau masih sedang dalam proses pembangunan. Namun adanya Hukum Tanah Nasional di Indonesia menjelaskan bahwa peralihan hak terjadi setelah dibuatnya akta jual beli di hadapan Pejabat Pembuat Akta Tanah. Masalah yang diteliti dalam penelitian ini adalah perlindungan hukum bagi pembeli satuan rumah susun yang hanya berdasarkan perjanjian pengikatan jual beli yang satuan rumah susun tersebut telah memenuhi syarat pemasaran tetapi belum melakukan penandatangan akta jual beli. Metode yang digunakan dalam penulisan tesis ini adalah metode penelitian hukum yuridis normatif yaitu penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan kepustakaan atau data sekunder belaka. Hasil penelitian ini diharapkan berguna bagi penulis dalam pengembangan dan pembangunan ilmu hukum. Berkaitan dengan hal tersebut di atas dan berdasarkan hasil penelitian dan analisis yang telah diperoleh dapat disimpulkan bahwa berdasarkan teori perlindungan hukum internalnya dapat dilihat dalam perjanjian pengikatan jual beli yang ternyata hak dan kewajiban pembeli dengan developer tidak seimbang sehingga sebetulnya melalui perlindungan hukum internal itu calon pembeli tidak mendapatkan perlindungan karena perjanjian perikatan jual beli yang diberikan oleh developer telah disiapkan terlebih dahulu dan merupakan kontrak standar developer yang tidak dapat diubah. Untuk perlindungan hukum eksternalnya dalam kasus ini berdasarkan pada Pasal 1 ayat (11) Undang Undang Republik Indonesia Nomor 20 Tahun 2011 tentang Rumah Susun mengartikan Sertipikat Hak Milik Atas Satuan Rumah Susun sebagai tanda bukti kepemilikan atas sarusun di atas tanah hak milik, hak guna bangunan atau hak pakai di atas tanah negara, serta hak guna bangunan atau hak pakai di atas tanah hak pengelolaan. Oleh karena itu, pihak developer harus memberikan sertifikat hak milik atas satuan rumah susun, sebab pihak kedua telah menjalankan kewajibannya. / The commitment of sale and purchase agreement of houses or apartments is a legal product made by a Notary Public to create an agreement between the developer and prospective buyers in the sale and purchase of houses or apartments, which the developer can carry out before construction begins or is in the process of constructions. However, the National Land Law in Indonesia explains that the transfer of rights occurs after a deed of sale and purchase is made before the Land Deed Making Officer. The problem studied in this study is legal protection for the buyer of the apartments unit, which is only based on a commitment of sale and purchase agreement in which the apartments unit has met the marketing requirements but has not signed the sale and purchase deed. The method used in writing this thesis is a normative juridical legal research method, namely library law research which is carried out by examining library materials or secondary data. The results of this study are expected to be useful for writers in the development and development of legal science. In connection with the foregoing and based on the results of research and analysis that has been obtained, it can be concluded that based on the theory of internal legal protection, it can be seen in the binding sale and purchase agreement which turns out that the rights and obligations of the buyer and the developer are not balanced so that through internal legal protection the prospective buyer does not get protection because the sale and purchase agreement provided by the developer has been prepared in advance and is a standard developer contract that cannot be changed. For external legal protection in this case, based on Article 1 paragraph (11) of the Law of the Republic of Indonesia Number 20 of 2011 concerning Apartments defines the Certificate of Ownership of Flat Units as proof of ownership of a condominium on land with property rights, building use rights or right of use on state land, as well as the right of use of building or right of use on land of management right. Therefore, the developer must provide a certificate of ownership of the apartment unit because the second party has carried out its obligations.
