Abstract

The research purpose in this scientific paper is to determine the role of Notary and Officer Land Deed Maker in the service of Electronic Mortgage Right, and to find out the obstacle of Notary and Officer Land Deed Maker in the service of Electronic Mortgage Right. The research method used in this scientific paper is normative legal research by examining library material. The type of data used in this scientific paper consist of Primary Data and Secondary Data. Primary Data is obtained directly from the field through interview and Secondary Data is obtained from a literature study consisting of Legislation, Law Book, Legal Journal. The type of Approach used in this research is the Legislation Approach and Data Analysis is carried out qualitatively. The research result obtained in this scientific work is the role of the Notary in the service of Electronic Mortgage Right is making Credit Agreement Deed and legalizing Credit Agreement made under the hand. The role of Officer Land Deed Maker is making Letter Power for Imposing Mortgage Right and Deed of Granting Mortgage Right. Officer Land Deed Maker before making Deed of Granting Mortgage Right must check the certificate that is guaranteed through htel.atrbpn.go.id. Officer Land Deed Maker provide Deed Number on Deed of Granting Mortgage Right which is signed to be registered with Officer Land Deed Maker insert Data and uploading the Requirement Document through Mitra.atrbpn.go.id since the enactment of Minister Agrarian and Spatial Regulation Number 5 of 2020. The National Land Agency issues an Electronic Mortgage Right Certificate if the Requirement Document are complete and Officer Land Deed Maker keep the Electronic Mortgage Right Certificate in Officer Land Deed Maker Minutes of Deed for Officer Land Deed Maker Protocol. The obstacle of Notary in service of Electronic Mortgage Right is Document from Debtor which is Identity Card, Taxpayer Identification Number, Family Card are not appropriate when checked through mitra.atrbpn.go.id so Notary must validate the compatibility Photocopies of Document with Original Document. The obstacle of Officer Land Deed Maker in service of Electronic Mortgage Right is Debtor has not paid Land and Building Tax, the value of Mortgage Right submitted by Debtor is not in accordance with the Partial Value, Debtor Certificate has been blocked, mitra.atrbpn.go.id has server problem during working hour so Officer Land Deed Maker must report disturbance server to the National Land Agency for repair and must ensure that Debtor Document is complete./ Tujuan dari Penelitian dalam karya ilmiah ini adalah untuk mengetahui peran Notaris dan PPAT dalam pelayanan Hak Tanggungan Elektronik, dan untuk mengetahui hambatan Notaris dan PPAT dalam pelayanan Hak Tanggungan Elektronik. Metode Penelitian yang digunakan dalam karya ilmiah ini adalah Penelitian Hukum Normatif dengan meneliti Bahan Pustaka. Jenis Data yang digunakan dalam karya ilmiah ini terdiri dari Data Primer dan Data Sekunder. Data Primer diperoleh secara langsung dari lapangan melalui wawancara dan Data Sekunder diperoleh dari Studi Kepustakaan yang terdiri dari Peraturan Perundangan, Buku Hukum, Jurnal Hukum. Jenis Pendekatan yang digunakan dalam karya ilmiah ini adalah Pendekatan Peraturan Perundangan dan Analisis Data dilakukan secara Kualitatif. Hasil Penelitian yang diperoleh dalam karya ilmiah ini adalah Peran Notaris dalam pelayanan Hak Tanggungan Elektronik yaitu membuat Akta Perjanjian Kredit dan melegalisir Perjanjian Kredit yang dibuat dibawah tangan. Peran PPAT dalam pelayanan Hak Tanggungan Elektronik yaitu membuat Surat Kuasa Membebankan Hak Tanggungan dan Akta Pemberian Hak Tanggungan. PPAT sebelum membuat Akta Pemberian Hak Tanggungan harus melakukan Pengecekan Sertifikat yang dijaminkan melalui htel.atrbpn.go.id. PPAT memberikan Nomor Akta pada Akta Pemberian Hak Tanggungan yang ditandatangani untuk didaftarkan dengan PPAT menginput Data dan mengunggah Dokumen Persyaratan melalui mitra.atrbpn.go.id sejak berlakunya Permen ATR 5/2020. Badan Pertanahan Nasional menerbitkan Sertifikat Hak Tanggungan Elektronik apabila Dokumen Persyaratan lengkap dan PPAT menyimpan Sertifikat Hak Tanggungan Elektronik dalam Minuta Akta PPAT untuk Protokol PPAT. Hambatan Notaris dalam pelayanan Hak Tanggungan Elektronik adalah Dokumen dari Debitur yaitu Kartu Tanda Penduduk, Nomor Pokok Wajib Pajak, Kartu Keluarga tidak sesuai ketika dilakukan pengecekan melalui mitra.atrbpn.go.id sehingga Notaris harus melakukan pengesahan kecocokan Fotokopi Dokumen dengan Dokumen Asli. Hambatan PPAT dalam pelayanan Hak Tanggungan Elektronik yaitu Debitur belum membayar Pajak Bumi dan Bangunan, Nilai Hak Tanggungan yang diajukan Debitur tidak sesuai dengan Nilai Parsial, Sertifikat Debitur terdapat blokir, mitra.atrbpn.go.id mengalami gangguan server pada jam kerja sehingga PPAT harus melaporkan gangguan server kepada Badan Pertanahan Nasional untuk diperbaiki dan PPAT harus memastikan bahwa Dokumen dari Debitur sudah lengkap.
