Abstract

This study aims to conduct a study of legal protection for consumers when conducting transactions electronically (e-commerce) and examine the obstacles faced in legal protection of consumers when conducting transactions electronically (e-commerce). This research includes normative juridical research, where the main data used is secondary data, both primary legal materials, secondary legal materials and tertiary legal materials. To obtain a valid answer, authentic interpretation and systematic interpretation are used. The results of this study conclude that legal protection for consumers in buying and selling transactions through electronic media consists of two concepts, namely preventive legal protection and repressive legal protection. Preventive legal protection is legal protection for the community aimed at preventing disputes. The form of prevention is guidance for consumers, the provisions of which are contained in Article 29 of the UUPK, the provisions of the supervision from the government are contained in Article 30 of the UUPK and the right to electronic information which originates from the system in Article 7 of the ITE Law. Then repressive legal protection is a form of legal protection which is more aimed at resolving disputes. Settlement of disputes between business actors and consumers in electronic trading activities can be resolved through litigation and non-litigation channels. The litigation dispute resolution provisions are contained in Article 48 of the UUPK by taking into account Article 45 of the UUPK. Then the non-litigation dispute resolution provisions are contained in Article 39 paragraph (2) of the ITE Law. As for the problems that arise in the legal protection of consumers in e-commerce transactions, there are 2 (two) problems, namely juridical issues consisting of the validity of the agreement according to Article 1320 of the Civil Code; settlement of disputes in e-commerce transactions that are not covered by UUPK; the absence of a guarantee institution for the validity of online stores and non-juridical problems including security in transactions; consumers do not understand in e-commerce transactions. / Penelitian ini bertujuan untuk melakukan kajian tentang perlindungan hukum terhadap konsumen pada saat melakukan transaksi secara elektronik (e-commerce) dan mengkaji kendala- kendala yang dihadapi dalam perlindungan hukum terhadap konsumen ketika melakukan transaksi secara elektronik (e-commerce). Penelitian ini termasuk penelitian yuridis normatif, dimana data utama yang digunakan adalah data sekunder, baik bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Untuk memperoleh jawaban sahih digunakan penafsiran otentik dan penafsiran sistematis. Hasil penelitian ini menghasilkan kesimpulan bahwa perlindungan hukum bagi konsumen dalam transaksi jual beli melalui media elektronik terdiri dari dua konsep yaitu perlindungan hukum preventif dan perlindungan hukum represif. Perlindungan hukum secara preventif adalah perlindungan hukum bagi masyarakat bertujuan untuk mencegah terjadinya sengketa. Bentuk pencegahan tersebut yaitu pembinaan terhadap konsumen ketentuannya terdapat dalam Pasal 29 UUPK, pengawasan dari pemerintah ketentuannya terdapat dalam Pasal 30 UUPK dan hak informasi elektronik yang beasala dari sistem pada Pasal 7 UU ITE. Kemudian perlindungan hukum represif yaitu bentuk perlindungan hukum dimana lebih ditujukan kepada penyelesaian sengketa. Penyelesain sengketa antara pelaku usaha dan konsumen dalam kegiatan perdagangan elektronik dapat diselesaikan melalui jalur litigasi dan non litigasi. Penyelesaian sengketa jalur litigasi ketentuannya terdapat dalam Pasal 48 UUPK dengan memperhatikan Pasal 45 UUPK. Kemudian penyelesaian sengketa non litigasi ketentuannya terdapat dalam Pasal 39 ayat (2) UU ITE. Adapun permasalahan-permasalahan yang timbul dalam perlindungan hukum terhadap konsumen dalam transaksi e-commerce ada 2 (dua) permasalahan, yaitu permasalahan yuridis yang terdiri dari keabsahan perjanjian menurut Pasal 1320 KUH Perdata; penyelesaian sengketa dalam transaksi e-commerce yang tidak terjangkau UUPK; tidak adanya lembaga penjamin keabsahan toko online dan permasalahan non yuridis meliputi keamanan dalam bertransaksi; tidak pahamnya konsumen dalam bertransaksi e-commerce.
