Abstract

Menurut Peraturan Menteri ATR/KBPN Nomor 5 Tahun 2020 Dokumen Elektronik adalah setiap informasi yang dibuat, diteruskan, dikirimkan, diterima, atau disimpan dalam bentuk analog, digital, elektromagnetik, optikal, atau sejenisnya, yang dapat dilihat, ditampilkan dan/atau didengar melalui komputer atau Sistem Elektronik. Sesuai dengan Peraturan Kepala BPN RI Nomor 8 Tahun 2012 dalam blanko APHT tersebut masih tertulis bahwa lembar kedua akta disampaikan ke Kantor Pertanahan, berikut dengan penyimpanan lembar pertama APHT di Kantor PPAT. Dalam penelitian ini, pengumpulan data dilakukan menggunakan pendekatan undang-undang (statute approach). Dalam metode pendekatan perundang-undangan pemahaman akan hierarki dari perundang-undangan adalah penting mengingat hierarki menunjukkan suatu struktur dan pada struktur tersebut, masing-masing bagian dalam struktur terdapat kedudukannya masing-masing, sehingga dengan memahami hierarki dari suatu perundang-undangan maka akan terlihat kedudukan dari peraturan perundang-undangan yang satu dengan peraturan perundang-undangan lainnya. Dari hasil penelitian tersebut, menghasilkan kesimpulan bahwa kewajiban PPAT terhadap penyimpanan Lembar Kedua Akta Pemberian Hak Tanggungan pada kantor PPAT, yaitu bahwa kewajiban penyampaian APHT secara elektronik adalah PPAT harus menyimpan 2 (dua) asli akta, yaitu lembar pertama APHT yang termasuk ke dalam bundel minuta akta dan lembar kedua APHT yang termasuk ke dalam bundel warkah sebagai arsip. Kendati disimpan sebagai warkah, minuta lembar kedua APHT tetap berkedudukan sebagai akta otentik, sehingga PPAT bertanggungjawab atas penyimpanan dan pemeliharaan 2 (dua) asli akta yang disimpan olehnya./ According to the Minister of ATR/KBPN Regulation Number 5 of 2020 Electronic Documents are any information created, forwarded, sent, received, or stored in analog, digital, electromagnetic, optical, or similar forms, which can be seen, displayed and/or heard through a computer. or Electronic Systems. In this study, data collection was carried out using a statute approach. In the statutory approach method, understanding the hierarchy of legislation is important considering that the hierarchy shows a structure and in that structure, each part of the structure has its own position, so that by understanding the hierarchy of a piece of legislation, it will show the position from one statutory regulation to another. From the results of the study, it was concluded that PPAT's obligation to keep the Second Sheet of the Deed of Granting Mortgage at the PPAT office, namely that the obligation to submit APHT electronically is that PPAT must keep 2 (two) original deeds, namely the first sheet of APHT which is included in the minuta bundle. deed and second sheet of APHT which is included in the warkah bundle as an archive. Even though it is kept as a warkah, the minutes of the second sheet of APHT still have the position as an authentic deed, so that PPAT is responsible for the storage and maintenance of 2 (two) original deeds that are kept by him.
