Abstract

Karya cipta musik berupakan salah satu bentuk hasil karya dari akal dan kreativitas manusia, karya cipta musik termasuk salah satu bentuk ciptaan yang dilindungi dalam ranah Hak Cipta. Perlindungan Hak Cipta di Indonesia diatur dalam Undang- Undang Nomor 28 tahun 2014 tentang Hak Cipta dan Hak Terkait. Penelitian dalam tesis ini terfokus kepada suatu urgensi pembuatan Perjanjian Lisensi Hak Cipta musik yang dibuat dalam bentuk Akta Notariil dimana Perjanjian Lisensi yang dibuat dalam bentuk Akta Notariil memiliki kekuatan pembuktian lebih kuat dibanding Perjanjian Lisensi yang dibuat dalam bentuk akta bawah tangan. Penelitian ini bertujuan untuk mengetahui berbagai peraturan terkait dengan kekuatan pembuktian perjanjian lisensi karya cipta musik yang dibuat dalam bentuk akta Notariil dan peran-peran Notaris dalam pelaksanaan pembuatan perjanjian lisensi karya cipta musik dalam bentuk akta notariil yang dikaitkan dengan Peraturan Pemerintah Nomor 56 tahun 2021 tentang Pengelolaan Royakti Hak Cipta Lagu dan/atau musik. Dalam penelitian ditemukan bahwa pembuatan perjanjian Lisensi musik di Indonesia masih jarang dibuat dalam bentuk akta notaril dikarenakan rendahnya sosialisasi meskipun sudah terdapat berbagai peraturan terkait yang menunjang perlindungan hak para pihak yang terlibat dalam pembuatan perjanjian Lisensi hak cipta musik, hal ini mengakibatkan lemahnya kekuatan pembuktian di muka persidangan dan kemungkinan untuk terjadi sengketan di kemudian hari lebih besar. / Musical works are a form of creation from human reason and creativity, music copyrighted works are one of the forms of creation that are protected in the realm of Copyright. Copyright protection in Indonesia is regulated in Law Number 28 of 2014 concerning Copyright and Related Rights. The research in this thesis focuses on the urgency of making a Music Copyright License Agreement made in the form of a Notarial Deed where the License Agreement made in the form of a Notary Deed has stronger evidentiary power than the License Agreement made in the form of a private deed. This study aims to find out the various regulations related to the strength of proof of the music copyright license agreement made in the form of a notarial deed and the roles of the notary in the implementation of the making of a music copyright license agreement in the form of a notarial deed associated with Government Regulation Number 56 of 2021 concerning Management Royakti Copyright Song and/or music. In the study it was found that the making of music license agreements in Indonesia is still rarely made in the form of a notarial deed due to the low level of socialization even though there are various related regulations that support the protection of the rights of the parties involved in making music copyright license agreements, this results in weak strength of evidence in advance. trial and the possibility for disputes to occur in the future is greater.
