Abstract

This research aims to find out the legal protection of Gojek online drivers for unilateral cancellation of food orders (GomFood) by consumers. This research also aims to find out the resolution of the dispute in the case of unilateral cancellation of food orders (Go Food) by consumers against Gojek online drivers. The research method used is using normative-empirical methods. This normative-empirical method is the combination of normative legal approaches with the support of various empirical elements. Normative-empirical legal research on the implementation of normative law provisions (Laws) in its role in certain legal events that occur in society. This research prioritizes secondary data in the form of primary, secondary and tertiary legal materials. Secondary data is strengthened and supported by primary data in the form of interview results with sources related to research topics and researchers also ask some questions as a benchmark when conducting interviews with online drivers and PT Gojek Indonesia Medan Operational Office. The results of the research obtained is legal protection against Gojek online drivers for the cancellation of food orders (Go Food) can be through 2 (two) legal protections, namely preventive and repressive. Preventive legal protection from PT Gojek which is an effort made to prevent losses to online drivers. While repressive legal protection is an effort made after the occurrence of losses or problems, namely online drivers have the right to sue consumers for losses in accordance with Article 1243 of the Civil Code. Then, the resolution of disputes when there is a unilateral cancellation of food orders by consumers resulting in losses to online drivers who are not due to the fault of the online driver and so far no one has ever reached the path of litigation but only through non-litigation channels that make mediation efforts between parties and consumers. Then if mediation efforts fail, it will be followed up by Go-Jek in accordance with the report received./ Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap driver online Gojek atas pembatalan orderan makanan (Go Food) secara sepihak oleh konsumen. Penelitian ini juga bertujuan untuk mengetahui penyelesaian sengketa dalam kasus pembatalan orderan makanan (Go Food) secara sepihak oleh konsumen terhadap driver online Gojek. Metode penelitian yang digunakan yaitu menggunakan metode normatif-empiris. Metode normatif-empiris ini merupakan penggabungan pendekatan hukum normatif dengan dukungan dari berbagai unsur empiris. Penelitian hukum normatif-empiris mengenai implementasi ketentuan hukum normatif (Undang-Undang) dalam perannya pada peristiwa hukum tertentu yang terjadi di masyarakat. Penelitian ini mengutamakan data sekunder yaitu berupa bahan hukum primer, sekunder dan tersier. Data sekunder dikuatkan dan didukung oleh data primer yang berupa hasil wawancara dengan narasumber yang terkait dengan topik penelitian dan peneliti juga mengajukan beberapa pertanyaan sebagai tolak ukur pada saat melaksanakan wawancara dengan pihak driver online dan pihak PT Gojek Indonesia Kantor Operasional Medan. Hasil penelitian yang peneliti dapatkan adalah perlindungan hukum terhadap driver online Gojek atas pembatalan orderan makanan (Go Food) dapat melalui 2 (dua) perlindungan hukum yaitu preventif dan represif. Perlindungan hukum preventif dari PT Gojek yang merupakan suatu upaya yang dilakukan untuk mencegah terjadinya kerugian terhadap driver online. Sedangkan perlindungan hukum represif adalah upaya yang dilakukan setelah terjadinya kerugian atau masalah yaitu driver online berhak menuntut konsumen atas kerugian sesuai dengan Pasal 1243 KUH Perdata. Kemudian, penyelesaian sengketa ketika terjadi pembatalan orderan makanan secara sepihak oleh konsumen yang mengakibatkan kerugian terhadap driver online yang bukan karena kesalahan driver online tersebut dan sejauh ini belum ada yang pernah sampai ke jalur litigasi melainkan hanya melalui jalur non litigasi yaitu melakukan upaya mediasi antara pihak dan pihak konsumen. Kemudian apabila upaya mediasi gagal maka akan ditindaklanjuti oleh pihak Gojek sesuai dengan laporan yang diterima.
