Abstract

Penelitian ini membahas tentang perselisihan transaksi jual beli rumah susun antara pelaku usaha (pengembang) dengan konsumen (pembeli) tentang keterlambatan penyerahan Sertipikat Hak Milik Satuan Rumah Susun (SHMSRS), pengembang diajukan permohonan Penundaan Kewajiban Pembayaran Utang (PKPU) oleh pembeli dengan mendalilkan syarat utang sebagai permohonan PKPU adalah keterlamabatan penyerahan Sertipikat tersebut. Penelitian ini menggunakan metode penulisan hukum yuridis normatif untuk memberikan data yang bersifat deskriptif analitis dengan menggunakan metode pendekatan yang terdiri dari pendekatan kasus, pendekatan perundang-undangan dan pendekatan penelitian untuk menghasilkan kesimpulan. Penelitian ini menganalisa hasil putusan PKPU terhadap PT. Duta Paramasindo sejahtera dikaitkan dengan pengaturan perundang-undangan yang terkait dengan kewajiban penyerahan sertipikat yang dipersamakan sebagai utang serta penerapannya dengan prinsip keadilan dan kepastian hukum. Dari penelitian diperoleh kesimpulan bahwa kewajiban penyerahan Sertipikat tidak dapat dipersamakan sebagai utang karena nilai keterlambatan administrasi tersebut tidak dapat dinilai dalam jumlah uang dan tidak dapat dibuktikan secara sederhana serta tidak sesai dengan ketentuan Undang-undang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Kedudukan Konsumen (Pembeli) dalam transaksi jual belui rumah susun sangat cukup terlindungi dengan adanya undang-undang Perlindungan Konsumen namun disisi lain kedudukan Pelaku Usaha terdapat sisi kelemahan yang lebih sering dianggap sebagai pihak yang tidak beritikad baik yang mengakibatkan kepastian hukum belum berjalan dengan baik/This research discusses the dispute over the sale and purchase of flats between business actors (developers) and consumers (buyers) regarding delays in the delivery of Flat Ownership Certificates (SHMSRS), the developer submitted an application for Suspension of Payment (PKPU) by the buyer by arguing as a request for PKPU is the delay in submitting the certificate. This research uses the method of writing empirical normative juridical law to provide descriptive analytical data using an approach consisting of a case approach, statutory approach and research approach to generate conclusions. This research analyzes the results of the PKPU decision on PT. Duta Paramasindo Sejahtera is associated with statutory arrangements related to the obligation to submit certificates which are equated as debt and their application with the principles of justice and legal certainty. From the research it was concluded that the obligation to submit Certificates cannot be equated as debt because the value of administrative delays cannot be assessed in terms of money and cannot be proven simply and is not in accordance with the provisions of the Bankruptcy Law and Suspension of Payment. The position of consumers (buyers) in the sale and purchase of flats is quite adequately protected by the existence of the Consumer Protection Act, but on the other hand, the position of business actors has a weakness which is more often seen as a party that does not have good intentions which results in legal certainty not going well.
