Abstract

Pandangan tentang plagiarisme harus diluruskan. Masih banyak yang memandang plagiarisme hanya sebagai pelanggaran etika namun tidak demikian halnya ketika karya yang telah dijiplak dilindungi oleh Undang-Undang Hak Cipta. Salah satu dari karya yang sangat digemari orang awam adalah lagu. Di Indonesia sudah ada banyak contoh di mana sebuah lagu diduga menjiplak lagu lain seperti lagu Kekeyi yang dituduh menjiplak lagu Novi Umar dan Papa T. Bob dan lagu Papa Uzi yang dituduh menjiplak lagu Meghan Trainor dan Kevin Kaddish. Fenomena ini memicu pertanyaan apakah Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta memberikan kerangka yang memadai dalam menentukan apakah plagiarisme terjadi dalam dugaan kasus plagiarisme lagu. Untuk menjawab pertanyaan tersebut, penelitian ini dilakukan dengan menggunakan metode penelitian normatif empiris dengan menerapkan studi kasus dan pendekatan komparatif dan dengan mewawancarai praktisi, akademisi, dan perancang hukum bidang Hak Cipta dan musisi yang kemudian dianalisis oleh penulis dengan menggunakan metode kualitatif. Berdasarkan penelitian ini, dapat dipahami bahwa kerangka umum standar plagiarisme lagu tidak memadai dalam menentukan apakah plagiarisme lagu terjadi atau tidak. Hal ini sangat berbeda dengan apa yang terjadi di Amerika Serikat dan Britania Raya yang masing-masing memiliki standar plagiarisme lagu yang mampu menjawab pertanyaan apakah plagiarisme lagu terjadi atau tidak. Dari penelitian ini dapat disimpulkan bahwa regulasi tentang plagiarisme lagu itu diperlukan. Penulis menyarankan agar pengaturan tentang standar plagiarisme lagu akan diatur di Indonesia dalam waktu dekat. / The view regarding plagiarism ought to be corrected. There are still many that views plagiarism merely as a violation of ethics. However, such is not the case when the works that have been plagiarised are protected by Copyright law. One of the works that are very dear to the common is a song. In Indonesia, there have been many instances where other songs have allegedly plagiarized a song like Kekeyi who has been alleged in plagiarizing Novi Umar and Papa T. Bob's song and Papa Uzi who has been alleged in plagiarizing Meghan Trainor and Kevin Kaddish’s song. This phenomenon triggers the question of whether Law Number 28 of 2014 concerning Copyright provides an adequate framework in determining these alleged song plagiarism cases. In answering such question, this research is done by normative empirical research method, by applying the case study and comparative approach and by interviewing practitioners, academics, and legal drafters in Copyright and musicians, which is then analyzed by the author using the qualitative method. Pursuant to this research, it can be understood that the general framework of song plagiarism standard is not adequate in determining whether song plagiarism is taking place or not. This is very different from what is taking place in the United States and the United Kingdom that has their respective song plagiarism standard that are able to solve the question of whether song plagiarism is happening or not. From this research, it can be concluded that the regulation concerning song plagiarism is crucial. The author suggests that the regulation concerning song plagiarism standard shall be regulated in Indonesia in the near future.
