Abstract

As information technology advances grow, the exchange of information and/or content traffic, including those containing copyrighted content, becomes easier and faster. Anyone can easily access, upload, enjoy and obtain copyrighted works through the Over the Top service. However, it has the potential for everyone, whether consciously or not, to violate the rights of others in the form of works contained in the Over the Top Service. There needs to be legal protection for Broadcasting Rights for cinematography or films uploaded through the Over the Top platform. The method used is the normative legal research method. Law Number 28 of 2014 concerning Copyright does not recognize the nomenclature of Broadcasting Rights. Films are copyrighted works protected by Copyright. One of the developing digital eras is the Over the Top Service which has a very close relationship with Copyright. Whereas screening of films through the Over the Top service can be categorized as film piracy as stipulated in Article 113 of Law Number 28 of 2014 concerning Copyright. The Amendments of the regulations it is necessary to revise Law Number 28 of 2014 concerning Copyright, in this case, an article inserted in Article 54, Article 55, and Article 56 of Law Number 28 of 2014 concerning Copyright which regulates the prevention of violations of Copyright based on information technology, to be inserted relating to the prevention of Copyright infringement on the Over the Top service which can comprehensively cover the digitization of creations so that the copyright owners and/or related rights holders are increasingly protected for the existence of their creations. Key Words: Copyright, Neighboring Rights, and Over the Top / konten, termasuk yang mengandung konten berhak cipta, menjadi lebih mudah dan cepat. Siapa pun dapat dengan mudah mengakses, mengunggah, menikmati, dan memperoleh karya berhak cipta melalui layanan Over the Top. Namun, berpotensi bagi setiap orang, baik disadari maupun tidak, untuk melanggar hak orang lain dalam bentuk karya yang terdapat dalam Layanan Over The Top. Perlu adanya perlindungan hukum terhadap Hak Siar atas sinematografi atau film yang diunggah melalui platform Over the Top. Metode yang digunakan adalah metode penelitian hukum normatif. Undang- Undang Nomor 28 Tahun 2014 tentang Hak Cipta tidak mengenal nomenklatur Hak Siar. Film adalah karya berhak cipta yang dilindungi oleh Hak Cipta. Salah satu era digital yang berkembang adalah Layanan Over The Top yang sangat erat kaitannya dengan Hak Cipta. Bahwa pemutaran film melalui layanan Over the Top dapat dikategorikan sebagai pembajakan film sebagaimana diatur dalam Pasal 113 Undang- Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Perubahan peraturan tersebut perlu dilakukan perubahan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, dalam hal ini pasal yang disisipkan dalam Pasal 54, Pasal 55 dan Pasal 56 Undang- Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang mengatur pencegahan pelanggaran Hak Cipta berdasarkan tentang teknologi informasi, yang akan disisipkan terkait pencegahan pelanggaran Hak Cipta pada layanan Over The Top yang secara komprehensif dapat mencakup digitalisasi ciptaan, sehingga pemilik Hak Cipta dan/atau pemegang hak terkait semakin terlindungi keberadaan ciptaannya.
