Abstract

Penelitian ini bertujuan untuk memberi penjelasan perlindungan secara hukum dalam kasus pertanahan yang memiliki sertifikat ganda serta memberi penjelasan langkah apa yang bisa diambil jika terjadi sengketa sertifikat ganda. Dalam hal pendaftaran pertanahan banyak kekeliruan yang telah terjadi baik atasnama kepemilikan ataupun luas dan detail objeknya, sehingga perlu adanya wawasan atas penyelesaian kasus tersebut. Penelitian ini akan membahas penyelesaian kasus sertifikat ganda yang menggunakan metode yuridis normatif yang dilkakukan dengan cara meneliti bahan pustaka atau sumber hukum yang ada. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil dalam penelitian ini adalah penyelesaian dapat dilakukan dengan dua cara yaitu melalui pengadilan (Pengadilan Negeri dan Pengadilan Tata Usaha Negara atau diluar pengadilan yaitu dengan upaya administratif melalui pengaduan pada BPN ataupun dilakukannya mediasi)./This research was purposed to provide an explanation of legal protection in land cases that have dual certificates and to explain what steps can be taken in the event of a dual certificate dispute. During the step of land registration, oftenly, there were many mistakes have occurred, whether regarding the name of the ownership or in the area and details of the object, Therefore, there is a need for examination to the settle of this kind of case. This study will discuss the resolution of the dual certificate case by using the normative juridical method which is carried out by conducting a research based on the other similar research and existing legal sources. The approaches that were used in this research is the statutory approach, conceptual approach and case approach. The result of this research has found that the settlement of this matter can be done in two ways, which are through the courts (District Court and State Administrative Court or outside the court) and by administrative efforts through complaints to BPN or mediation.
