Abstract

Pada industri kontruksi, kontraktor sebagai salah satu pihak yang berperan penting dalam pelaksanaan dituntut untuk dapat melakukan perencanaan dan eksekusi pekerjaan secara terukur sesuai dengan perencanaan yang telah disepakati dengan pengguna Jasa. Dalam hal ini kesepakatan kerjasama atau lebih dikenal sebagai kontrak antara kontraktor dan pengguna jasa adalah hal penting yang menjadi acuan bersama dalam mengukur pelaksanaan pekerjaan. Mengingat fungsinya yang vital kontrak kerja kontruksi idealnya mampu mengakomodir hak dan kewajiban para pihak secara adil untuk mencapai tujuan proyek. Namun kenyataannya terdapat situasi dimana tidak ada ruang bagi kontraktor dan penggunajasa untuk menegosiasikan proyek karena pada dokumen tender yang diterima kontraktor dituliskan secara tegas bahwa tidak boleh ada pengecualian dari draft kontrak yang diberikan oleh pengguna jasa. Hal ini dapat menimbulkan konflik bagi para pihak dikemudian hari karena kontrak hanya dilihat dari sudut pandang pengguna jasa. Meskipun deminikian, kontraktor di Indonesia dapat memitigasi potensi konflik sekaligus potensi kerugiannya dengan meninjau kontrak menggunakan UU No 2 tahun 2017 yang memuat ketentuan – ketentuan yang harus dituliskan pada kontrak kerja kontruksi. Selain itu, khusus pada kontrak proyek EPC dapat digunakan FIDIC Silver Book yang secara umum telah dipakai oleh pelaku kontruksi di dunia. Penelitian ini dilakukan dengan didasari oleh latar belakang kondisi tersebut. Metode yang di gunakan adalah metode Delphi dimana penentuan klausa kontrak yang sangat berpengaruh menimbulkan konflik didapatkan dari studi literatur kemudian divalidasi oleh pakar. Setelah dilakukan peninjaauan pada kontrak proyek EPC XYZ terdapat 16 klausa kontrak yang berisiko menimbulkan konflik yaitu : kegagalan pembayaran, masalah bawah permukaan tanah, risiko- risiko terhadap desain, perencanaan yang kurang lengkap, lingkup pekerjaan, waktu pelaksanaan, penghentian sementara pekerjaan dan pengakhiran perjanjian/ pemutusan kontrak, ganti rugi keterlambatan, keadaan memaksa, klaim, klausa mengenai perubahan dan differing site condition, penutupan proyek, perpanjangan waktu penyelesaian, penyelidikan oleh kontraktor, pemberian ganti rugi dan pengujian. Hasil penelitaian ini adalah analisis risiko potensi konflik yang diakibatkan oleh klausa- klausa tersebut dan rekomendasi mitigasinya bagi kontraktor. / In the construction industry, the contractor as one of the parties that plays an important role in the project is required to be able to carry out planning and execution of work in a measurable manner in accordance with the planning that has been agreed with the owner. In this case, the cooperation agreement or better known as the contract between the contractor and the owner is an important thing that becomes a common reference in measuring the implementation of the work. Given its vital function, the construction work contract should ideally be able to accommodate the rights and obligations of the parties fairly to achieve project goals. However, in reality there are situations where there is no room for contractors and service users to negotiate the project because the tender documents received by the contractor are explicitly written that there should be no exceptions to the draft contract provided by the service user. This can lead to conflict for the parties in the future because the contract is only seen from the perspective of the service user. However, contractors in Indonesia can mitigate potential conflicts as well as potential losses by reviewing contracts using Law No. 2 of 2017 which contains provisions that must be written on construction contracts. In addition, specifically on EPC project contracts, the FIDIC Silver Book can be used which has generally been used by stake holder construction in the world. This research was conducted based on the background of these conditions. The method used is the Delphi method where the determination of contract clauses that are very influential in causing conflicts is obtained from literature studies and then validated by experts. After reviewing the XYZ EPC project contract, there are 16 contract clauses that are at risk of causing conflicts, namely: payment failure, subsurface problems, risks to the design, incomplete planning, scope of work, implementation time, temporary cessation of work and termination of the agreement / termination of the contract, compensation for delay, force majeure, claims, clauses regarding changes and differing site conditions, project closure, extension of completion time, investigation by the contractor, compensation and testing. The result of this research is a risk analysis of potential conflicts caused by these clauses and mitigation recommendations for contractors.
