Abstract

Jual beli online merupakan hal yang sangat diminati masyarakat saat ini karena praktis dan juga cepat, maka dari itu terciptanya metode pembayaran secara COD untuk memudahkan masyrakat dalam melakukan kegiatan jual – beli secara online. Tetapi dalam pelaksanaannya terdapat kendala, yaitu adanya penolakan pembayaran COD dengan berbagai alasan tetapi didalam faktanya pembeli melakukan kegiatan jual – beli online tersebut dengan metode pembayaran COD. Tujuan tesis ini dibuat untuk mengetahui bahwa penolakan pembayaran jual beli online pada COD merupakan wanprestasi dan juga untuk keperluan syarat kelulusan pada pendidikan magister Hukum di Universitas Pelita Harapan. Jenis penelitian yang digunakan penulis sendiri yaitu yuridis normatif. Hasil dari analisa akan kasus ini yang dikaitkan okeh teori – teori, doktrin – doktrin, undang – undang dan juga literatur bahwa dari permasalahan pembeli, penjual bahkan pihak e commerce perlu melakukan tindakan serius atas hal yang sering terjadi ini. / People are increasingly interested in buying and selling online because it is convenient and quick. Therefore, the COD payment method has been created to make it easier for people to carry out buying and selling activities online. But in practice, there are obstacles, namely the refusal of COD payments for various reasons, but in fact the buyer carries out these online buying and selling activities with the COD payment method. The goal of this thesis was to discover whether or not refusal to pay for online buying and selling on COD is a default, as well as to fulfill graduation requirements in the Master of Law program at Pelita Harapan University. The type of research used by the author himself is normative-juridical. The findings of this case analysis are linked by theories, doctrines, laws, and literature that demonstrate that serious action is required to address the problems of buyers, sellers, and even e-commerce parties.
