Abstract

Inheritance requirements can be fulfilled if these three things are fulfilled, namely there are heirs, there are assets in the form of boedels (assets and liabilities) and there are heirs. The heir makes a will before a notary in order to have valid legal evidence. A will or testament is a statement from someone about what they want after they die. This thesis discusses two formulations of the problem, namely the making of will number 22 in terms of laws and regulations and the legal consequences of testament deed number 22 in the event that the inherited land has been auctioned off for repayment of the heir's debt based on decision number No. 5/Pdt.G/2022/PN.Pwt. Types of normative legal research on case No. 5/Pdt.G/2022/PN.Pwt, the case is a lawsuit by the heirs against the assets auctioned off by the bank to pay off the debt of the heir who is in default. It can be concluded that testament 22 number in decision number no. 5/Pdt.G/2022/PN.Pwt. made by the heir before notary Maria Emelia Widyanti Iskandar, S.H. May 27 2017. The plaintiff and the children of the heir before marrying the plaintiff were appointed as heirs. The heir gives a will, half of his property is given to the plaintiff and the other half is given to his children. Deed number 22 seen from the form including a general testament, namely a will with a general deed that must be made before a notary in the presence of two witnesses (Article 938/939 paragraph 1 of the Civil Code). The deed of will number 22, seen from its contents, includes a will for inheritance (erfstelling) as stipulated in Article 954 of the Civil Code, namely a letter containing a will in the name of the person making the will (heir) giving to one or more persons, part or all of the assets if he dies.
