Abstract

Undang-Undang Dasar Pokok-Pokok Agrarian terbit 1960 dan Peraturan Pemerintah tentang Pendaftaran tanah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah merumuskan perlindungan hukum namun masih terjadi pembelian tanah di bawah tangan kemudian penjualnya menghilang, bagaimana pembeli melakukan pendaftaran tanahnya sementara penjual menghilang menarik diteliti judul “Perlindungan Hukum Pembeli Beritikad Baik Terhadap Jual Beli Hak Guna Bangunan Di Bawah Tangan Terkait Pendaftaran Tanah Sesuai Peraturan Perundang-Undangan Yang Berlaku” karena masih saja ditemukan persoalan yang sama saat ini. Metode yuridis normatif adalah penelitian asas-asas hukum, penelitian sistematika hukum, penelitian sejarah hukum dan penelitian perbandingan hukum, mengambil sampel berkas jual beli yang tidak dapat didaftarkan disertai sampel putusan pengadilan kemudian dianalisa menggunakan undang-undang dan teori hukum perlindungan dari Satjipto Raharjo dimana perlindungan hukum adalah pengayoman kepada hak asasi manusia yang dirugikan orang lain dan perlindungan tersebut diberikan kepada masyarakat agar mereka dapat menikmati semua hak-hak yang diberikan oleh hukum serta teori kepastian hukum dari Gustav Radbruch menjelaskan hukum yang baik adalah memiliki tiga nilai yaitu nilai keadilan, kemanfaatan dan kepastian hukum.Jawaban penelitian jual beli tanah yang lunas dibayar pembelinya maka hak pembelian atas tanah akan mendapat perlindungan hukum sebagaimana hasil gugatan kepengadilan sehingga kepastian hukum direalisasikan mewujudkan perlindungan hukum bagi pembeli untuk keperluan pendaftaran tanah dengan kondisi penjual tidak diketahui keberadaannya seperti nyonya Srixxxxx pembeli yang beritikad baik mengajukan gugatan kepengadilan agar kepastian kepemilikan tanahnya dapat diproses di kantor pertanahan./The Basic Agrarian Law was published in 1960 and Government Regulations On Land Registration Number 24 Year 1997 formulate legal protection yet there are still land purchase under-hand then the seller disappear, how the buyer register his/her own land while the seller disappear is interesting to research under the tittle “Legal Protection For Good Intention Buyer Who Have Good Intention Of Buying Selling Building Right Underhand Relate To Land Registration In Accordance With Applicable Legislation Regulation” due to the same cases that are still founded until these days.Normative juridical method is about principles of law research, the systematics of law research, the history of law research, and the comparison of law research take the sample of buying and selling document which cannot be registered with the samples of court decisions then analyzed with constitution and theory of law protection from Satjipto Raharjo that legal protection is the protection of human rights that are aggrieved by other people and that protection is given to people so they can enjoy the rights that are given by law and the certainty of law by Gustav Radbruch explain that the good law has three values, those values are justice values, expediency value, certainty value.The answer of research about buying and selling land that is paid in full by the buyer will receive legal protection as a result court lawsuit so that legal certainty is realized and realizing legal protection for buyer for the purpose of land registration with the condition that the seller’s whereabouts are unknown, such as Mrs. Sriyanti, the buyer in good intention filed a lawsuit to the court so that the certainty of land ownership can be processed at the land office.
