Abstract

PPAT merupakan pejabat umum yang memiliki kewenangan untuk membuat Akta Autentik. Pada praktik masih terdapat permasalahan hukum mengenai kelalaian PPAT dalam menjalankan jabatannya yang melanggar ketentuan dalam Undang-Undang Jabatan PPAT yang membuat PPAT terjerat dalam perbuatan melawan hukum yang dilakukan baik dengan sengaja ataupun turut serta melakukan pelanggaran. Bentuk perbuatan melawan hukum yang dilakukan oleh PPAT yaitu adalah dengan hanya memperlihatkan lembaran terakhir untuk ditandatangani penghadap dan tidak membacakan akta secara langsung kepada penghadap serta membuat akta jual beli yang nilai objek jual beli berbeda dengan perjanjian kredit. Tesis ini membahas mengenai bagaimana jika dalam prosedur pembuatan akta jual beli mengandung unsur perbuatan melawan hukum dan bagaimana tanggung jawab PPAT terkait dengan prosedur pembuatan akta jual beli yang mengandung unsur perbuatan melawan hukum dalam Putusan Pengadilan Negeri Bogor Nomor: 137/Pdt.G/2020/PN. Bgr. Penelitian ini menggunakan metode yuridis normatif dengan jenis data sekunder yang diperoleh dari studi kepustakaan yang kemudian dianalisis secara kualitatif. Hasil dari penelitian ini ialah bahwa tugas dan tanggung jawab terkait dengan jabatannya dalam membuat akta PPAT harus dilakukan sesuai dengan data yang benar yang didukung oleh dokumen-dokumen yang sesuai dengan peraturan perundang-undangan berdasarkan Pasal 53 Ayat (2) Peraturan Kepala BPN Nomor 1 Tahun 2006 tentang Ketentuan Pelaksanaan PP Nomor 37 Tahun 1998 tentang Peraturan Jabatan PPAT. Pemberian keterangan yang tidak benar dalam akta dan tidak membacakan isi akta kepada penghadap termasuk pelanggaran berat yang dilakukan oleh PPAT dapat dikenakan sanksi pemberhentian dengan tidak hormat dari jabatannya oleh Kepala BPN. / PPAT is a public official who has the authority to make Authentic Deeds. In practice, there are still legal issues regarding the negligence of PPATs in carrying out their positions which violate the provisions of the PPAT Position Law which make PPATs entangled in unlawful acts committed either intentionally or participating in violations. The form of unlawful acts committed by the PPAT is by only showing the last sheet to be signed by the appeared and not reading the deed directly to the apparel and making a sale and purchase deed where the value of the object of sale and purchase is different from the credit agreement. This thesis discusses what if the procedure for making a sale and purchase deed contains elements of an unlawful act and how the responsibilities of the PPAT are related to the procedure for making a sale and purchase deed that contains elements of an illegal act in the Bogor District Court Decision Number: 137/Pdt.G/2020/ PN. Bgr. This study uses a normative juridical method with secondary data types obtained from literature studies which are then analyzed qualitatively. The results of this study are that the duties and responsibilities related to their position in making a PPAT deed must be carried out by the correct data supported by documents that are by statutory regulations based on Article 53 Paragraph (2) Regulation of the Head of BPN Number 1 Year 2006 concerning Provisions for Implementation of PP No. 37 of 1998 concerning PPAT Position Regulations. Providing incorrect information in the deed and not reading the contents of the deed to the apparel, including serious violations committed by the PPAT, can be subject to sanctions with dishonorable dismissal from his position by the Head of BPN.
