Abstract

KKPR (Kesesuaian Kegiatan Pemanfaatan Ruang) Yang dimohon atau di peroleh melalui Online Single Submission (OSS) yang diluncurkan pemerintah memang membuat proses mendapatkan perizinan usaha lebih singkat. terutama terkait perizinan berusaha dengan berbasis risiko, dimana risiko yang dimaksud yaitu potensi terjadinya cedera atau kerugian baik dari aspek kesehatan, keselamatan, lingkungan, Metode penelitian dilakukan melalui penelitian hukum normatif empiris yaitu penelitian yang dilakukan dengan cara mengkaji peraturan perundang-undangan yang berlaku atau diterapkan terhadap suatu permasalahan hukum tertentu, mengkaji perundang-undangan yang berkaitan dengan objek penelitian yang meliputi hukum primer dan sekunder. Perolehan Tanah yang dilakukan oleh Badan Usaha dengan keharusan mendapatkan KKPR yaitu sebagai pengganti izin lokasi melalui serta mengantisipasi terjadinya masalah Hukum. Hasil dari penelitian bahwa pemberian kewenangan kepada Bupati/ Walikota dalam rangka Penyelenggaraan perizinan di daerah, hanya untuk perizinan yang ada pada tingkat risiko rendah dan menengah rendah. Putusan hakim Pengadilan Mahkamah Agung pada Putusan Nomor 256 K/TUN/2020 Mahkamah agung tentang Penolakan perpanjangan Izin Lokasi PT. Jaya Indo Property Oleh Dinas Penanaman Modal dan Perijinan Satu Pintu Kabupaten Tangerang, dimana hasil perolehan tanah yang di bebaskan oleh Penggugat bukan merupakan bukti kuat serta dasar dalam Penggugat untuk mencabut atau membatalkan Izin Lokasi milik PT. Teluk Naga Perkasa. / The KKPR (Conformity of Space Utilization Activities) that is requested or obtained through the Online Single Submission (OSS) launched by the government does indeed make the process of obtaining business permits shorter. especially related to risk-based business licensing, where the risk in question is the potential for accidents or losses in terms of health, safety, environmental aspects. on a particular legal issue, descriptions of invitations relating to the object of research which include primary and secondary law. Land Acquisition is carried out by Business Entities with the obligation to obtain a KKPR, namely as a substitute for a location permit and to anticipate legal problems. The results of the study show that the granting of authority to Regents/Mayors in the context of the risk of administering permits in the regions, is only for permits that exist at low and medium levels. The Supreme Court judge's decision on Decision Number 256 K/TUN/2020 of the Supreme Court regarding the Rejection of the extension of the Location Permit for PT. Jaya Indo Property by the Tangerang Regency One-Stop Investment and Licensing Service, where the acquisition of land that was freed by the Plaintiff is not strong evidence as well as the basis for the Plaintiff to revoke or cancel the Location Permit belonging to PT. Teluk Naga Perkasa.
