Abstract

In 2014, European Union amends its food safety regulation in Commission Regulation (EU) 1146/2014. This new regulation started to be effective in May 18th 2015. One of the regulations is about the Maximum Residue Level (MRL) of anthraquinone in tea is amount of 0.02 mg/kg. It caused tea from several countries including Indonesia cannot enter the European market because their tea contains bigger amount of anthraquinone. Issues raised in this research are how consistence is Commission Regulation (EU) No 1146/2014 in applying the principle of scientific justification in SPS Agreement regarding the maximum residue level of anthraquinone in tea and how did the principle of scientific justification applied in WTO’s dispute settlement decisions. This research aimed to review the consistence of Commission Regulation (EU) No 1146/2014 regarding maximum residue level of anthraquinone in tea and to review the application of the scientific justification principle in WTO’s dispute settlement decisions. The research method used in this research is legal research with normative approach, which conducted based on primary legal material that related to this research. This research conclude that Commission Regulation (EU) No 1146/2014 is not consistent with the principle of scientific justification in SPS Agreement regarding the maximum residue level in tea and the application of scientific justification principle applied in the settlement of several case in agricultural commodity. In those cases, WTO declares that banning on trade without scientific evidence is invalid and is a form of violation to SPS Agreement. / Pada tahun 2014, Uni Eropa memperbaharui peraturan keamanan pangannya dalam Commission Regulation (EU) No 1146/2014. Peraturan ini mulai efektif berlaku pada 18 Mei 2015. Salah satu peraturan baru yang tertulis dalam peraturan ini adalah dibatasinya ambang batas maksimum senyawa antrakinon pada teh sebesar 0,02 mg/kg. Hal ini menyebabkan teh dari beberapa negara termasuk Indonesia tidak bisa masuk ke pasar Uni Eropa karena mengandung antrakinon yang lebih tinggi dari batas maksimum yang telah ditetapkan. Permasalahan yang diangkat dalam penelitian ini adalah bagaimana konsistensi Commission Regulation (EU) No 1146/2014 dalam penerapan prinsip scientific justification didalam SPS Agreement dalam penetapan ambang batas maksimum senyawa antrakinon pada teh dan bagaimana penerapan prinsip scientific justification didalam putusan-putusan sengketa WTO. Tujuan penelitian ini adalah untuk mengkaji konsistensi Uni Eropa dalam penerapan scientific justification SPS Agreement dalam penetapan ambang batas maksimum (MRL) senyawa antrakinon pada komoditas teh dan mengkaji penerapan prinsip scientific justification pada SPS Agreement didalam putusan-putusan sengketa WTO. Metode penelitian yang digunakan adalah metode dengan pendekatan yuridis normatif. Dari penelitian ini diperoleh hasil bahwa Commission Regulation (EU) 1146/2014 tidak konsisten dengan prinsip scientific justification didalam SPS Agreement dalam penetapan ambang batas maksimum senyawa antrakinon pada teh dan penerapan prinsip scientific justification didalam putusan-putusan sengketa WTO diterapkan dalam penyelesaian beberapa kasus penolakan komoditas pertanian. Dalam kasuskasus tersebut WTO menyatakan penolakan yang dilakukan tanpa scientific evidence adalah tidak valid dan merupakan pelanggaran pada SPS Agreement.
