Abstract

Pelaut merupakan profesi yang cukup penting di Negara Kesatuan Republik Indonesia ini. Pelaut mempunyai peranan utama dalam banyak perusahaan pelayaran di Indonesia. Regulasi Jaminan Sosial di Indonesia telah diatur secara khusus dan spesifik dalam Undang-undang Badan Pelaksana Jaminan Sosial (UUBPJS) yang mengatur bahwa seluruh jaminan sosial tenagakerja di Indonesia wajib dilindungi oleh BPJS. Pada tahun 2020 dengan munculnya ketentuan baru Undang-undang Nomor 11 Tahun 2020 Tentang Cipta Kerja hal tersebut memberikan semangat baru dan ketegasan yang jelas terhadap tim BPJS untuk menegakkan pengawasan ketaatan perusahaan-perusahaan terhadap keanggotaan BPJS, tidak terkecuali Perusahaan Pelayaran baik untuk karyawan darat maupun Pelaut yang bekerja mengikuti kontrak laut. Mengingat kembali bahwa pada tahun 2016 Indonesia meratifikasi Konvensi Ketenagakerjaan Maritim Tahun 2006 yang dituangkan menjadi Undang-undang Republik Indonesia Nomor 15 Tahun 2016 Tentang Pengesahan Maritime Labour Convention, 2006, di mana ketentuan tersebut memiliki juga persyaratan bahwa Perusahaan Pelayaran wajib memiliki asuransi khusus bagi Pelaut atau yang dikenal dalam dunia Pelayaran sebagai Asuransi Protection & Indemnity (P&I). Sehingga ada objek yang sama yang kemudian diatur oleh dua Kementerian yang berbeda dengan regulasi yang serupa yang membuat ketidakpastian hukum bagi Pelaut karena regulasi yang ada tumpang tindih dan memberatkan Pemberi Kerja karena harus menerapkan dua aturan yang berlaku di Indonesia. / Seafarers are quite an important profession in the Unitary. Recalling that in 2016 Indonesia ratified the 2006 Maritime Labor Convention as outlined in the Law of the Republic of Indonesia Number 15 of 2016 Concerning Ratification of the Maritime Labor Convention, 2006, in which this provision also includes a requirement that Shipping Companies must have special insurance for Seafarers or known in the shipping world as Protection & Indemnity Insurance (P&I). So that there are the same objects which are then regulated by two different ministries with similar regulations which create legal uncertainty for seafarers because the existing regulations overlap and are burdensome for employers because they have to apply two regulations that apply in Indonesia.
