Abstract

As the world largest Nickel producer, Indonesia exports refined nickel products such as Nickel Matte, FeNi and NPI. The increasing number of exports will boost the rate of reserve depression of nickel mineral, caused particularly by regulation of nickel processing and refining. In order to enhance people’s welfare as mandated by Article 33 Paragraph 3 of the 1945 Constitution, the proper policy on mineral conservation, in the sense of maximum efficient and best possible utilization of existing mineral resources is urgently needed. Accordingly, Mining Law was amended by changing the paradigm of natural resource management which so called “Dig – Export” toward the paradigm of increasing its added value. Article 102, Article 103, and Article 104 of Law Number 4 of 2009 concerning Minerals and Coals, defined new obligations for mining business to do processing and refining in Indonesia. In fact, this obligation encounter various polemics over juridical issues such as inconsistency on policy and implementation. In addition, revision of laws and regulations affect legal uncertainty, as well as dualism on the authority of The Ministry of Energy and Mineral Resources and The Ministry of Industry for the same nickel smelter processing and refining facilities. This research focus on analysing the dualism of the regulations and its impacts on legal certainty, justice, and benefits. The research method is normative juridical research verified by empirical research. The research found that the licensing authority of nickel smelter should be under Ministry of Industry for the continuity of linkage forward industry.
