Abstract

Sertifikat Syariah merupakan sertifikasi yang menjamin penerapan prinsip￾prinsip syariat islam, bagi badan usaha yang memiliki sertifikat syariah. DSN￾MUI sebagai lembaga dibawah naungan MUI memiliki tugas dan kewenangan mengeluarkan sertifikat syariah bagi setiap badan usaha. Pada dasarnya setiap kebijakan yang telah dikeluarkan oleh lembaga apapun harus memiliki tanggungjawab hukum. Karena hal tersebut menyangkut masyarakat secara luas. Menurut teori tanggung jawab yang dijelaskan Abdulkadir Muhammad, terdapat teori tanggung jawab mutlak (stirck liability) yaitu akibat perbuatan melanggar hukum tanpa mempersoalkan kesalahan, didasarkan pada perbuatannya baik secara sengaja maupun tidak sengaja, artinya meski bukan kesalahannya tetap bertanggungjawab atas kerugian yang timbul akibat perbuatanya. Teori tersebut sudah cukup mewakili dan menjelaskan tentang tanggungjawab Majelis Ulama Indonesia atas kasus PT. Golden Traders Indonesia Syariah. Skripsi ini berjudul “ Pertanggungjawaban Hukum Majelis Ulama Indonesia terhadap kasus PT. Golden Traders Indonesia Syariah “ Tujuan penelitian ini guna mengetahui batas tanggungjawab lembaga Majelis Ulama Indonesia atas kasus PT. Golden Traders Indonesia Syariah. Metode penelitian ini yuridis normatif yang didesain dengan teori – teori yang dipelajari selama perkuliahan. / The certificate is a certification which guarantees the application of the principles of Islamic Sharia, for the business entity that owns the certificate. DSN￾MUI as institutions under the auspices of the MUI has the duty and authority to issue certificates of Sharia to any business entity. Basically any policy that has been issued by any institution must have legal responsibility. Because it concerns the wider community. According to the theory of responsibility described Abdulkadir Muhammad, there is a theory of absolute responsibility (stirck liability) that is due to unlawful acts without questioning errors, based on his actions either intentionally or unintentionally, meaning that although not his fault remains responsible for the harm caused by perbuatanya. The theory is quite representative and explain about the responsibility of the Indonesian Ulema Council on the case of PT. Golden Traders Indonesia Syariah. This skripsi entitled "Legal Accountability of Majelis Ulama Indonesia to PT. Golden Traders Indonesia Syariah "The purpose of this study is to determine the limit of responsibility of the Indonesian Ulema Council on the case of PT. Golden Traders Indonesia Syariah. This normative juridical research method is designed with theories learned during the lecture.
