Abstract

Perkembangan bisnis di dunia semakin lama semakin cepat, apalagi didukung oleh teknologi informasi internet. Barang dan jasa dijual secara online di dunia siber. Bisnis berjalan dua puluh empat jam melintasi lintas yuridiksi negara. Pembayaran juga dilakukan secara online dalam dunia siber seperti lewat kartu kredit dan juga salah satu metode pembayaran dalam ruang siber yang saat ini sedang diminati adalah lewat perusahaan pengelola rekening bersama dengan sistem escrow service. Penelitian ini bertujuan untuk mengetahui syarat – syarat legalitas yang wajib dipenuhi perusahaan pengelola rekening bersama dengan sistem escrow service dalam transaksi elektronik dan perlindungan hukum bagi konsumen (penjual dan pembeli ) yang menggunakan jasa rekening bersama dengan sistem escrow service dalam transaksi elektronik. Metode penelitian yang digunakan adalah yuridis normatif yakni upaya mencari penyelesaian masalah dengan meneliti dan mengkaji norma hukum positif dengan melakukan studi kepustakaan. Hasil penelitian ini menunjukan bahwa syarat – syarat legalitas perusahaan rekening bersama memenuhi ketentuan yang berlaku bagi perusahaan baik berbentuk CV maupun PT dan perlindungan hukum bagi konsumen ada dalam UU ITE, KUH Perdata, UU PK. / Business development in the world faster and faster , especially supported by information technology internet . Goods and services sold online in the cyber world . Business runs twenty- four hours across jurisdictions across the country . Payment is also done online in the cyber world as through credit cards and also one of the methods of payment in cyber space that is currently in demand is through the management company joint account with an escrow service system This study aims to determine the conditions - conditions that must be met legality management company joint account with an escrow service system in electronic transactions and legal protections for consumers ( sellers and buyers ) who use the services of a joint account with an escrow service system in electronic transactions . The method used is a normative juridical namely the search for a settlement of the problem by researching and reviewing the positive legal norms to do library research . These results indicate that the terms - terms of legality company joint accounts comply with the provisions applicable to companies both in the form of CV or PT and legal protection for consumers in the law information and electronic transaction, civil law, consumer protection laws.
