Abstract

Latar belakang dalam penulisan tesis ini adalah terkuaknya kasus tindak pidana perdagangan orang dengan anak sebagai korbannya.Akibat persetujuan dari orang tua kandungnya, anak yang dilahirkan diserahkan kepada Panti Asuhan dengan menerima imbalan pembayaran.Panti Asuhan sebagaimana tertuang dalam ketentuannya tentang yayasan sosial telah melakukan hal yang bertentangan dengan tujuan yang semestinya.Dengan mengatas namakan Adopsi, pihak Panti Asuhan menjadikan anak yang kodratinya masih memerlukan pemeliharaan namun digunakan sebagai objek perdagangan orang dengan tujuan utamanya yaitu eksploitasi sehingga anak tersebut menderita baik secara psikis, fisik, mental, ekonomi dan sosial.Tujuan pengeksploitasian ini bukanlah hal yang manusiawi anak sebagai sosok yang lemah dan rentan dijadikan budak, pengemis dan dijual organ tubuhnya bahkan diambil organ tubuhnya untuk kemudia digantikan dengan narkotika. Selanjutnya, tujuan dalam penulisan tesis ini adalah untuk mendapatkan pemahaman tentang sejauh mana hukum positif di Indonesia tentang Tindak Pidana Perdagangan Orang dan Peraturan Pemerintah tentang pelaksanaan pengangkatan anak dalam memberikan perlindungan hukum terhadap anak pasca adopsi. Metode penelitian ini menggunakan pendekatan yuridis normatif dengan menggunakan studi kepustakaan, mengkaji norma perundang-undangan yang berlaku tentang pengangkatan anak, tindak perdagangan orang, yayasan dan mengenai perlindungan anak. Dapat disimpulkan, hukum positif di Indonesia pada hakekatnya memberikan perlindungan hukum terhadap adopsi .Namun perlu diketahui, tindak pidana perdagangan orang merupakan kejahatan yang terorganisasi dengan keuntungan yang menjanjikan sehingga kenyataanya dengan kecanggihan tekhnologi dan berkembangnya zaman membuat para sindikat menemukan berbagai modus operandi dalam aksinya. Diharapkan Negara lebih memberikan perhatian dalam memberikan perlindungan hukum terhadap korban perdagangan orang khususnya anak, meningkatkan kesadaran hukum dari masyarakat dan aparatur pemerintah serta memberikan hukuman tegas terhadap pelaku tindak pidana perdagangan orang / The background of this thesis idea is revealing the cases criminal act of human trafficking, and the children as the victims. The result is : By approval from their parents, childrens who have been raised were given to the charital institution (orphanage) with money rewards. The Orphanage as the provision of social foundation has doing on the contrary from the way that it should be. In the name of Adoption/adopting, the orphanage turns the children ( which in certain still need to be supervised from their real parents ) into an object of human trafficking with the exploitation as a main goals of this case, It’s causing Damage for childrens who are involved, The childrens are physicly and mentally abused the in economy and social. The Purpose from this exploitation is against human rights literally, Childrens are weak, and vulnerable they became slaves, beggars , and in some other case they were practically sold human body parts from the childrens itselves, and in the future they trade it with drugs and narcotics. Furthermore, the purpose of this thesis are to ensure the comprehension about how far the positive sides of Indonesian law enforcement, in order to follow up The Criminal Act of Human Trafficking and the Government rules about Adoption and giving legal protection for the children after they get adopted. This research methods are using normative law approach with using literature studies, and assessing the norma of legislation which applied with adoption, human trafficking, foundation and the children;s protection. The Conclusion is, the positive law in Indonesia practically giving law protection for Adoption. But there are certain way that we should need to know, The criminal act of human trafficking is a crime that well organized therefore it will bring fortunes and it’s quite promising. Nowadays, In the reality with the new era of technology sophistication makes the syndicates founds many alternatives way to do the certain actions. Hopefully the law enforcement of this country will provide more attention and giving legal protection to the victims of human trafficking especially childrens. To gaining the conscious of law from the society and government officials, and giving the right punishment to the rule of law of human trafficking.
