Abstract

Dalam proses jual beli ini membutuhkan suatu perjanjian tertulis berupa Akta Jual Beli yang dibuat oleh Pejabat Pembuatan Akta Tanah (PPAT), tetapi jika para pihak yang belum bisa memenuhi persyaratan untuk membuat akta jual beli dihadapan Pejabat Pembuat Akta Tanah maka dapat membuat perjanjian pendahuluan yaitu Perjanjian Pengikatan Jual Beli yang selanjutnya disebut sebagai PPJB. PPJB dilaksanakan untuk memberikan kesepakatan dalam perjanjian pendahuluan antara pembeli serta penjual yang dimaksudkan untuk mengikat antara kedua belah pihak. Dalam prakteknya, sering ditemui bahwa pihak pembeli yang sudah mengikat tersebut melalui PPJB kemudian pihak penjual melakukan pengikatan dengan pihak lain atas properti yang telah diikat oleh pembeli pertama tersebut. Pemerintah sudah menanggulangi hal ini dengan menerbitkan Peraturan Menteri Nomor 18 Tahun 2021 tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun, dan Pendaftaran Tanah, pada peraturan ini perjanjian pengikatan jual beli dapat di catatkan di kantor pertanahan. Namun setelah adanya pengaturan mengenai PPJB ini pun masih terdapat permasalahan dan adanya pihak-pihak yang menyalahgunakan PPJB. Berdasarkan hal ini, maka penelitian ini mengangkat permasalahan yaitu mengenai implementasi pencatatan pengikatan jual beli menurut Peraturan Menteri Nomor 18 Tahun 2021 tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun, dan Pendaftaran Tanah dan mengenai kedudukan PPJB Lunas setelah dicatatkan di Kantor Pertanahan. Penelitian ini dianalisis menggunakan metode penelitian yuridis normatif dan analisis kualitatif, menggunakan data sekunder. Dari hasil penelitian, ditemukan bahwa belum optimal implementasi pencatatan perjanjian pengikatan jual beli dikarenakan tidak terdapat pencatatan PPJB Lunas di beberapa Kantor Pertanahan serta kedudukan PPJB Lunas setelah dicatatkan hanya menjadikan berpindahnya hak keperdataan bukan sebagai dasar pengalihan hak atas tanah. / The buying and selling process requires a written agreement in the form of a Sale and Purchase Deed made by the Land Deed Making Official (PPAT), but if the parties cannot fulfill the requirements for making a sale and purchase deed before the Land Deed Making Official, they can make a preliminary agreement, namely the Agreement. Sale and Purchase Agreement, hereinafter referred to as PPJB. PPJB is implemented to provide agreement in a preliminary agreement between the buyer and seller which is intended to be binding between both parties. In practice, it is often found that the buyer has already bound it through PPJB and then the seller has tied up with another party for the property that was tied up by the first buyer. The government has addressed this by issuing Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Flats, and Land Registration. In this regulation, sales and purchase agreements can be recorded at the land office. However, even after the regulation regarding PPJB, there are still problems and there are parties who abuse PPJB. Based on this, this research raises issues, namely regarding the implementation of recording sales and purchase agreements according to Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Flats, and Land Registration and regarding the position of Paid PPJB after it is registered at the Land Office. This research was analyzed using normative juridical research methods and qualitative analysis, using secondary data. From the research results, it was found that the implementation of the recording of sales and purchase agreements was not optimal because there was no recording of the Paid PPJB in several Land Offices and the position of the Paid PPJB after it was registered only made the transfer of civil rights not the basis for the transfer of land rights
