Abstract

Notaris merupakan profesi Hukum yang bertujuan mendukung terwujudnya kepastian hukum bagi masyarakat dengan membuat akta autentik yang memiliki kekuatan pembuktian yang sempurna. Akan tetapi, dalam praktik di lapangan sering notaris yang bersangkutan dalam melaksanakan kewenangannya untuk pembuatan akta autentik tersebut dimanfaatkan oleh pihak-pihak yang memiliki itensi tidak baik dan berakibat pada permasalahan hukum. Salah satu permasalahan hukum yang sering dihadapi oleh notaris akibat tindakan kecurangan dan itikad tidak baik oleh penghadap tersebut adalah permasalahan hukum yang berhubungan dengan Identitas palsu yang diperlihatkan oleh pengahadap pada notaris dan berakibat pada gugatan pihak 3 di peradilan di kemudian hari. Penelitian ini bertujuan untuk memecahkan permasalahan hukum berupa permasalahan identitas palsu yang diserahkan penghadap berhubungan dengan kekuatan pembuktian suatu akta autentik yang dibuat berdasarkan dugaan identitas palsu tersebut, batas tanggung jawab notaris berhubungan dengan adanya gugatan identitas palsu tersebut dan penelitian juga bertujuan agar memberikan informasi lebih lanjut bagi kalangan akademisi dan notaris-notaris mengenai tanggung jawab notaris terhadap kebenaran identitas penghadap dalam pembuatan akta autentik sekaligus menumbuhkan kesadaran hukum masyarakat untuk mengutamakan kebenaran identitas sebagai penghadap apabila akan membuat akta Notaris. " Notary is a legal profession whose aim is to support the realization of legal certainty for society by making authentic deeds that have perfect evidentiary power. However, in practice in the field, the notary concerned in exercising his authority to make authentic deeds is often exploited by parties who have bad intentions and result in legal problems. One of those legal problems is legal problems related to false identities shown by debtor to the notary and resulting in third party lawsuits in court at a later date. This research aims to solve legal problems in the form of the problem of fake identities submitted by the person in relation to the evidentiary strength of an authentic deed made based on the alleged fake identity, the limits of the notary's responsibility related to the existence of a fake identity lawsuit and the research also aims to provide further information for academics and notaries regarding the notary's responsibility for the correctness of the identity of the presenter in making authentic deeds while at the same time raising public legal awareness to prioritize the correctness of the identity of the presenter when making a notarial deed."
