Abstract

Percepatan investasi menjadi salah satu dari sebelas klaster utama dalam Undang- Undang Cipta Kerja mendapatkan perhatian khusus dari pemerintah, menjadi salah satu pendorong kemajuan ekonomi nasional. Kemudahan berusaha dan penyederhanaan perizinan serta penyelarasan kebijakan pusat-daerah bertujuan untuk meningkatkan iklim investasi dan menarik investor untuk berinvestasi di Indonesia. Banyaknya investor asing yang masuk ke Indonesia untuk membuka usaha dan mendirikan perusahaan membawa dampak terbukanya lowongan kerja bagi Tenaga Kerja Indonesia, tidak hanya Warga Negara Indonesia saja, berdirinya perusahaan asing di Indonesia turut serta membawa Warga Negara Asing untuk bekerja dalam proyek investasi asing tersebut. Warga Negara Asing yang masuk ke Indonesia dalam rangka bekerja haruslah di filter dan dibatasi penggunaannya, khususnya dalam penempatan pada jabatan struktural di perusahaan, mengingat amanat Undang-Undang Ketenagakerjaan harus mengutamakan Warga Negara Indonesia dalam semua jabatan atau posisi yang tersedia. Tugas akhir ini menggunakan tipe penelitian yuridis normatif, penelitian dilakukan melalui studi kepustakaan dengan menggunakan pendekatan Undang-Undang (statute approach) pendekatan konseptual (conceptual approach). Penelitian ini bertujuan untuk mengetahui kebenaran terkait penempatan Tenaga Kerja Asing pada posisi jabatan personalia dalam sebuah perusahaan beserta akibat hukum bagi Tenaga Kerja Asing itu sendiri dan perusahaan yang melakukan penyalahgunaan jabatan berdasarkan peraturan perundang-undangan. Hasil analisis dalam penelitian ini menunjukkan bahwa penempatan Tenaga Kerja Asing dalam jabatan personalia tidak dibenarkan karena telah melanggar ketentuan dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, Peraturan Pemerintah Nomor 34 Tentang Penggunaan Tenaga Kerja Asing, dan Undang-Undang Cipta Kerja. Akibat hukum dari adanya pelanggaran bagi perusahaan berupa sanksi pidana atau sanksi administratif, sedangkan bagi Tenaga Kerja Asing belum ditemukan peraturan perundang-undangan yang mengatur secara spesifik tentang akibat hukumnya/Accelerating investment as one of the eleven main clusters in the Omnibus Law has received special attention from the government, becoming one of the drivers of national economic progress. Ease of doing business and simplification of licensing as well as alignment of central-regional policies aims to improve the investment climate and attract investors to invest in Indonesia. The large number of foreign investors entering Indonesia to open businesses and establish companies has had the impact of opening up job vacancies for Indonesian workers, not only Indonesian citizens, the establishment of foreign companies in Indonesia has also brought in foreign citizens to work in these foreign investment projects. Foreign nationals who enter Indonesia for work must be filtered and their use limited, especially in placement in structural positions in companies, bearing in mind the mandate of the Manpower Law which must prioritize Indonesian citizens in every available positions. This final assignment uses a normative juridical research type, research is carried out through literature study using a statute approach and conceptual approach. This research aims to find out the truth regarding the placement of foreign workers in personalia positions in a company along with the legal consequences for foreign workers themselves and companies who abuse their positions based on statutory regulations. The results of the analysis in this research show that the placement of foreign workers in personalia positions is not justified because it violates the provisions of Law Number 13 of 2003 concerning Employment, Government Regulation Number 34 concerning the Use of Foreign Workers, and the Omnibus Law. The legal consequences of violations for companies are in the form of criminal sanctions or administrative sanctions, while for foreign workers there are no statutory regulations that specifically regulate the legal consequences.
