Abstract

Hak Kekayaan Intelektual (HKI) adalah hak yang lahir dari kegiatan intelektual yang menghasilkan karya intelektual dan membutuhkan perlindungan hukum. Sistem HKI telah berkembang secara signifikan dalam dua dekade terakhir, memicu diskusi tentang aspek filosofis, nilai-nilai nasionalisme, urgensi pengaturan, serta politik ekonomi dan hubungan luar negeri. Hak Cipta, sebagai salah satu bentuk HKI yang melindungi hasil karya kreatif, diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Salah satu karya cipta yang dilindungi adalah lagu, yang mencakup hak moral dan hak ekonomi bagi pencipta atau pemegang hak. Lagu "Halo-Halo Bandung," yang diciptakan oleh Ismail Marzuki, memiliki nilai historis dan nasionalisme bagi Indonesia. Namun, pada Mei 2020, lagu "Helo-Helo Kuala Lumpur" diunggah di YouTube dan kembali viral pada September 2023 karena diduga memplagiasi lirik asli "Halo-Halo Bandung" dengan beberapa perubahan kata. Hal ini menimbulkan kerugian material dan imaterial bagi pemegang hak cipta. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap lagu Halo-Halo Bandung berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, serta mencari solusi terhadap masalah plagiasi yang terjadi. Rumusan masalah dalam penelitian ini meliputi perlindungan hak cipta atas lagu "Halo-Halo Bandung" yang diubah menjadi "Helo-Helo Kuala Lumpur" dan solusi terhadap problematika plagiasi lagu "Halo-Halo Bandung" menjadi "Helo- Helo Kuala Lumpur". Penelitian ini diharapkan dapat memberikan pemahaman yang lebih mendalam mengenai perlindungan hukum lagu daerah dalam konteks HKI dan memberikan rekomendasi solusi yang tepat dalam menangani kasus plagiasi lintas negara di era digital. / Intellectual Property Rights (IPR) are rights arising from intellectual activities that result in intellectual works and require legal protection. In the national context, the IPR system has significantly developed over the past two decades, sparking discussions on philosophical aspects, nationalism values, the urgency of regulation, as well as economic and foreign relations policies. Copyright, as a form of IPR protecting creative works, is regulated under Law Number 28 of 2014 concerning Copyright. One of the protected works is a song, which includes moral rights and economic rights for the creator or rights holder. The song "Halo-Halo Bandung," composed by Ismail Marzuki, holds historical and nationalistic value for Indonesia. However, in May 2020, the song "Helo-Helo Kuala Lumpur" was uploaded on YouTube and went viral again in September 2023, allegedly plagiarizing the original lyrics of "Halo-Halo Bandung" with some word changes. This caused material and immaterial losses to the copyright holder. This research aims to analyze the legal protection of the song "Halo-Halo Bandung" based on Law Number 28 of 2014 concerning Copyright and to find solutions to the plagiarism issues that occurred. The research questions include the copyright protection of the song "Halo-Halo Bandung" altered to "Helo-Helo Kuala Lumpur" and solutions to the plagiarism issues of the song "Halo-Halo Bandung" becoming "Helo-Helo Kuala Lumpur." This research is expected to provide a deeper understanding of the legal protection of folk songs in the context of IPR and to offer appropriate solution recommendations in handling cross-country plagiarism cases in the digital era.
