Abstract

Penelitian ini bertujuan untuk menganalisis, mengidentifikasi, dan menguraikan konsep escrow account dan perjanjian dalam konteks transaksi jual beli mobil di Indonesia, serta mengkaji peran notaris sebagai penyedia jasa escrow account dalam transaksi tersebut berdasarkan peraturan perundang-undangan yang berlaku. Dengan menggunakan metode penelitian normatif empiris dengan pendekatan hukum perundang-undangan dan sistematis, penelitian ini mengungkapkan bahwa layanan escrow account disediakan oleh pihak ketiga yang netral untuk menyimpan dokumen, surat berharga, barang, atau uang berdasarkan perjanjian tertulis antara penjual, pembeli, dan pemegang escrow account. Perjanjian tersebut memuat petunjuk mengenai tata cara dan syarat-syarat pemindahan barang dan dana. Namun kewenangan notaris dalam memberikan jasa escrow account dalam transaksi mobil tidak diatur dan tidak dilarang dalam hukum Indonesia, khususnya dalam UUJN dan kode etik notaris. Dengan demikian, notaris tidak mempunyai kewenangan hukum untuk berperan sebagai penyedia jasa escrow account dalam transaksi mobil di Indonesia, namun hal tersebut juga tidak dilarang dalam ketentuan perundang-undangan yang berlaku. / This research aims to analyze, identify and explain the concept of escrow accounts and agreements in the context of car buying and selling transactions in Indonesia, as well as examining the role of notaries as providers of escrow account services in these transactions based on applicable laws and regulations. By using empirical normative research methods with a statutory and systematic legal approach, this research reveals that escrow account services are provided by a neutral third party to store documents, securities, goods or money based on a written agreement between the seller, buyer and escrow holder. accounts. The agreement contains instructions regarding the procedures and conditions for the transfer of goods and funds. However, the authority of notaries in providing escrow account services in car transactions is not regulated and is not prohibited in Indonesian law, especially in UUJN and the notary's code of ethics. Thus, a notary does not have the legal authority to act as an escrow account service provider in car transactions in Indonesia, but this is also not prohibited in the applicable statutory provisions.
