Abstract

Penelitian ini bertujuan untuk mengetahui perlindungan dan tanggung jawab yang diberikan oleh Bank CIMB NIAGA terhadap nasabah yang mengalami kerugian dalam penggunaan Internet Banking, serta untuk mengetahui pengaruh penggunaan Internet Banking terhadap cyber crime dan upaya penyelesaian sengketa Bank CIMB NIAGA apabila nasabah perbankan mengalami kerugian akibat transaksi perbankan menggunakan Internet Banking. Penelitian ini menggunakan metode penelitian yang bersifat normatif yuridis dengan menganalisa pasal-pasal dalam peraturan perundang-undangan serta doktrin hukum yang berkaitan dengan permasalahan. Dalam penelitian ini, yang diteliti pada awalnya adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, yang kemudian dilanjutkan dengan melakukan penelitian terhadap data primer pada praktiknya. Teknik pengumpulan data dilakukan dengan melakukan wawancara dengan lembaga jasa keuangan, dan pengisian kuesioner secara acak oleh nasabah terkait, serta didukung dengan studi pustaka baik melalui buku maupun jurnal hukum. Sebelum melakukan wawancara, peneliti memberikan daftar pertanyaan kepada narasumber agar mendapatkan hasil wawancara terstruktur. Data yang diperoleh dari hasil wawancara akan dianalisa secara deskriptif menggunakan analisis kualitatif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian menunjukkan bahwa, Bank CIMB NIAGA memberikan perlindungan secara implisit berupa pengawasan dan pembinaan yang baik oleh bank kepada nasabah dan eksplisit melalui Lembaga Penjamin Simpanan serta menjalankan tanggung jawab bank dengan menerapkan manajemen risiko, kerahasiaan bank, perlindungan konsumen dan menyediakan layanan call center 24 jam yang dapat digunakan nasabah untuk melakukan pengaduan. Pihak bank juga bertanggung jawab terhadap kerugian yang diakibatkan oleh kelalaian pihak bank. Perkembangan Internet Banking membawa dampak positif dan negatif, yaitu memudahkan nasabah bertransaksi perbankan tanpa mengkhawatirkan waktu dan lokasi, namun berpengaruh terhadap risiko Cyber Crime. Tindakan cyber crime yang dilakukan pelaku untuk merugikan nasabah adalah typosite, phising dan malware. Apabila terjadi kerugian, nasabah dapat menggunakan dua upaya penyelesaian hukum yang disediakan, yaitu secara internal yang akan diselesaikan oleh lembaga keuangan dan external yang akan diselesaikan di pengadilan atau diluar pengadilan dengan cara mediasi, ajudikasi dan arbitrase. / This research is conducted to determine the protection and responsibility given by Bank of CIMB NIAGA to customer whom experience losses in using Internet Banking, and also to determine the effect of using Internet Banking on cyber crime and CIMB NIAGA’s efforts in taking a legal action towards customer that experience in losses due to banking transaction using Internet Banking. This research uses juridical normative research methods by analyzing the section of the legislation. In this research, what we initially investigated was the secondary data consisting of primary legal material, secondary legal material and practical. Research data collection technique are obtained through literature review both from books and legal journals relation to the problems. Interview was conducted with Bank office, and also questionnaire were shared to bank customer in order to gain information that is needed to conduct this research. In conducting the interview, the author had given the question to the interviewee that will had the interview to make it easier to carry out structural interview. Data that author has obtained will be analyze descriptively using the qualitative analysis methods to get the answer of the problem. The results showed that Bank of CIMB NIAGA provided implicit protection in the form of good supervision and guidance by banks to customers and explicitly through the Indonesian Deposit Insurance Corporation and carried out bank responsibilities by implementing the risk of management, bank secrecy, consumer protection and providing 24-hour call center services which can be use by customer to make complaints. The bank is also responsible for the losses cause by bank negligence. The development of Internet Banking has both positive and negative impacts, which make customer easier to do banking transactions without worrying about time and location, but have an effect on the risk of cyber crime. Cyber crime actions that are often carried out by perpetrators to harm customers are typosite, phising and malware. In event of a loss, customer can use dispute resolution efforts provided which can be internally resolved by financial institutions and externally which can be done in court or out of court by mediation, adjudication and arbitration.
