Abstract

Dalam ruang lingkup agraria, tanah merupakan bagian bumi yang disebut permukaan bumi. Tanah yang dimaksudkan adalah dalam pengertian yuridis yang disebut hak. Hak Atas Tanah bersumber dari hak menguasai negara. Negara dapat memberikan tanah kepada seseorang atau badan hukum dengan sesuatu hak menurut peruntukan misalnya Hak Milik, Hak Guna Usaha, Hak Guna Bangunan, Hak Pakai atau memberikan Hak pengelolaan. Hak Pengelolaan merupakan hak menguasai negara yang kewenangannya sebagian dilimpahkan kepada pemegang hak. Perum Perumnas sebagai salah satu subyek hak pengelolaan, dalam membangun perumahan bekerjasama dengan pihak ketiga seperti pengembang dan memberikan Hak Guna Bangunan di atas hak pengelolaan dan bila telah beralih kepada masyarakat dapat dtingkatkan menjadi Hak Milik. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundangundangan yaitu dengan menelaah undang-undang dan regulasi yang bersangkut paut dengan yang diteliti. Dari hasil penelitian, dapat disimpulkan bahwa terjadinya Sertipikat Hak Milik atas nama Perorangan berada di atas Hak Guna Bangunan di atas Hak Pengelolaan didahului adanya perjanjian. Pelaksanaan hak pengelolaan dengan pihak ketiga menimbulkan hak dan kewajiban yang tertuang dalam perjanjian penggunaan tanah. Kedudukan hukum Sertipikat Hak Milik di atas Sertipikat Hak Guna Bangunan di atas Hak Pengelolaan menurut Undang–Undang Pokok Agraria dan Peraturan Pelaksanaanya, di dalam peraturan tersebut tidak terdapat aturan bahwa hak milik dapat berada di atas hak pengelolaan. Didalam Peraturan Menteri Negara Agraria/Kepala BPN No. 9 Tahun 1999 tentang Tata Cara Pemberian dan Pembatalan Hak Atas Tanah Negara dan Hak Pengelolaan, bahwa tidak ada aturan hak milik berada di atas hak pengelolaan. Aturan tersebut hanya mengatur bahwa Hak Pengelolaan dapat diberikan Hak Guna Bangunan dan Hak Pakai. Sehingga sampai saat belum ada pengaturan Peraturan Perundang-undangan yang mengatur mengenai Hak Milik di atas Hak Pengelolaan. / In agrarian scope, land is a part of the earth called the surface of the earth. The intended land is in a juridical sense called rights. The Right to Land originates from the right to control the state. The state can give land to a person or legal entity with certain rights according to the designation such as ownership rights, land use rights, land use rights, use rights or give management rights. Management Right is the right to control the state whose authority is partially delegated to the right holder. Perum Perumnas as one of the subjects of management rights, in developing housing in collaboration with third parties such as developers and granting Building Use Rights over management rights and if it has been transferred to the community can be increased to Ownership Rights. In this study, data collection was carried out using a statutory approach, namely by examining the laws and regulations that are relevant to the study. From the results of the study, it can be concluded that the ownership of the Certificate of Ownership on behalf of the Individual is above the Right to Building above the Right to Management preceded by an agreement. The exercise of management rights with third parties raises the rights and obligations contained in the land use agreement. Legal status of Ownership Certificate above Ownership Certificate of Building Use Rights over Management Rights according to the Basic Agrarian Law and Implementing Regulations, there are no rules in the regulation that ownership rights can be above management rights. In the Regulation of the Minister of Agrarian Affairs/Head of BPN No. 9 of 1999 concerning Procedures for Granting and Revoking Rights to State Land and Management Rights, that there are no rules of ownership above management rights. The regulation only stipulates that Management Rights can be granted Building Use Rights and Use Rights. So that until now there has been no statutory regulation governing ownership rights above management rights.
