Abstract

Secara yuridis yang dimaksud dengan cessie adalah suatu pengalihan piutang atas nama terhadap debitur (cessus), dari kreditur lama (cedent) kepada kreditur baru (cessionaris) dengan cara yang diatur oleh Undang-Undang yakni dengan jalan membuat akta cessie, baik akta otentik maupun akta dibawah tangan dan dengan kewajiban pemberitahuan (betokening, notice) kepada debitur, atau secara tertulis disetujui dan diakuinya oleh debitur. Putusan PN Bogor No. 73/Pdt.G/2018/PN Bgr mengabulkan untuk memberikan Hak kepada Penggugat untuk menjual sendiri ataupun kepada orang lain atas sebidang tanah dan bangunan serta benda-benda yang melekat diatasnya sebagaimana tertuang dalam Sertifikat HGB No. 3429/Kencana seluas 60m2, Surat ukur No. 285/Kencana/2014 untuk mengembalikan hutang Penggugat atas pembelian piutang dari Turut Tergugat dari pihak Tergugat yang menjadi debitur kredit macet. Diketemukan bahwa jaminan pelunasan kewajiban debitur tidak dibebani Hak Tanggungan sebagaimana diatur dalam UUHT No. 4 Tahun 1996 tentang Hak Tanggungan atas Tanah beserta Benda-Benda yang berkaitan dengan Tanah sehingga Penggugat tidak dapat melakukan penjualan atas objek jaminan kredit tesebut yang sangat merugikan kepentingan kreditur baru. Penelitian dalam penulisan ini adalah mengenai pengaturan cessie berdasarakan peraturan perundang-undangan serta kepastian hukum atas pengalihan hak atas nama (cessie) yang dibuat oleh Notaris kepada kreditur baru untuk menguasai objek jaminan dikaitkan dengan putusan PN Bogor No. 73/Pdt.G/2018/PN. Bgr. Permasalahan dijawab menggunakan metode penelitian hukum yuridis-normatif, penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan-peraturan dan literatur-literatur yang berkaitan dengan permasalahan yang diteliti, maka penelitian ini berbasis pada norma hukum dan perudangan-undangan. Hakim menyatakan sah pembelian piutang oleh kreditur baru karena dibuat dengan akta otentik dan sesuai Pasal 1320 KUHPerdata, dikarenakan Penggugat dapat memberikan bukti-bukti otentik yang tidak dapat disangkal lagi kebenarannya oleh Para Tergugat, maka Majelis Hakim memutuskan dijalankan terlebih dahulu permintaan dari Penggugat untuk diberikan hak menjual atas tanah serta benda-benda yang terletak diatasnya baik kepada diri sendiri maupun orang lain. / Legally, the definition of cessie is to transfer the receivable on behalf of the debtor (cessus), from the old creditor (cedent) to the new creditor (cessionary) which is regulated by the law by preparing the cessie deed authetically or under the hand with the obligation to give notification (betokening, notice) through the writing approved and acknowedged by the debtor. Bogor District Court Decision No. 72/Pdt.G/2018/PN Bgr granted to give law suit to the Plaintiff the right to sell by him self or to others over a plot of the land and building and objects attached to it as stated in the Certificate of Right Building No. 3429/Kencana with an area of 60m2, measurement letter No. 285/Kencana/2014 in order to return the Plantiff’s debt (for the purchase of receivables from Co-Defendant) from the Defendant as the bad debtor. It is found that the guarantee of payment of the debtor’s obligations is not burdened by the Rights of the Debtors as set out in the Liability Law Nomor 4 Year 1996 regarding Land Rights and Land Related Matters, therefore the Plaintiff’s position does not constitute a predecessor of Defendant’s Rights which can be advanced from other creditors, in this case the Plaintiff’s position is severely impaired. The research of this paper is about cessie arrangements based on laws and regulations and legal certainty over the transfer of rights related with cessie prepared by a Notary to the new creditors in order to dominate the object of the collateral assoicated with the decision of Bogor District Court No. 73/Pdt.G/2018/PN. Bgr. The problem is to answer using juridical-normative legal research methods, legal resecarch conducted by examining literature of secondary data as basic material to be investigated by conducting a search of regulations and literature relating to the problem under study, then this research is based on legal norms and regulations. The judge stated that the legal purchase of the receivables by new creditor was prepared with an authentic deed in accordance with Article 1320 of the Civil Code, because Mohamad Latif Soemantri was able to provide authentic evidence that could not be denied by the Defendants, the panel of judges decided to first run the request of the Plaintiff to be given the right to sell the land and obejcets located thereon both to himself and others.
