Abstract
PPAT sebagai pejabat umum yang berwenang untuk membuat akta tanah diharuskan untuk memiliki ketelitian, kecakapan, dan kemampuan di bidang hukum tanah agar akta-akta yang dibuatnya tidak akan menimbulkan permasalahan di kemudian hari bagi para pihak yang berkepentingan. Namun dalam kenyataannya masih banyak kasus PPAT di Indonesia yang melanggar kode etik dan membuat akta otentik tidak sesuai dengan tata cara dan ketentuan peraturan perundang-undangan yang berlaku yang mengakibatkan kerugian bagi para pihak. Sebagaimana studi putusan yang Penulis akan teliti ditemukan suatu penandatanganan Akta Jual Beli (AJB) tanpa tanggal dan tanpa harga yang didasari atas pinjaman dengan jaminan. Untuk melihat keabsahan atas pelaksanaan pinjaman dengan jaminan dengan penandatanganan AJB tersebut, diperlukan penelitian mengenai implementasi dari penandatanganan AJB tersebut. Dalam penelitian ini, pengumpulan data dilakukan dengan melakukan serangkaian kegiatan studi kepustakaan dan wawancara kepada dua orang Notaris/PPAT yaitu Ibu Stefanie Hertanto dan Bapak Aryadi. Dari hasil penelitian tersebut, dapat disimpulkan bahwa penandatangan AJB tanpa tanggal dan tanpa harga yang didasari atas pinjaman dengan jaminan adalah tidak sah dan terdapat pelanggaran tata cara dan prosedur dalam pembuatan AJB tersebut.
Pertanggungjawaban PPAT terhadap pelanggaran yang terjadi dibagi dalam 3 aspek, yaitu aspek tanggung jawab adinistratif, aspek tanggung jawab perdata, dan aspek tanggung jawab pidana. / As the public officials who are authorized to create land certificates, PPAT (Official Certifier of Title Deeds) should be meticulous, adept, and knowledgeable in the law of the land to ensure that the certificates they create will not cause disadvantages to the relevant parties in the future. However, in reality, there are a lot of cases where Indonesian PPAT violated the code of conducts and created authentic certificates which are not in accordance to the governing rules and regulations, resulting in losses to all parties involved. As in the study of court decision that the Writer will investigate, a Purchase Contract (AJB) based on a guaranteed loan was made without any date nor price. In order to determine the performance validity of the guaranteed loan through the signing of the contract, it is necessary to conduct a research on the implementation of the contract signing. In this research, the data are collected through a series of library research and interviews with two Public Notaries/PPAT, Ms. Stefanie Hertanto and Mr. Aryadi. From the research, the Writer concludes that the signing of the contract based on guaranteed loan without any date nor price is invalid, and the Writer also found violations against the requirements and procedures during the creation of the contract. Due to committing the violations, the PPAT are held to be responsible in 3 aspects, namely aspects of administrative responsibilities, aspects of civil liability, and aspects of criminal liability.
