Abstract

"Suatu Perikatan Perjanjian Jual Beli (PPJB) yang dituangkan dalam Akta merupakan akta otentik yang memiliki kekuatan pembuktian yang sempurna. Apabila hal-hal yang telah disepakati dalam akta pengikatan jual beli dilanggar atau tidak dipenuhi oleh para pihak yang membuatnya maka hal tersebut dapat dikatakan telah terjadi wanprestasi. Pasal 1266 ayat (2) KUHPerdata menyatakan bahwa untuk membatalkan suatu perjanjian harus dengan putusan hakim. Namun dalam prakteknya, meskipun Perikatan Perjanjian Jual Beli (PPJB) sudah memiliki kekuatan pembuktian yang sempurna, masih saja terjadi pembatalan yang dilakukan oleh salah satu pehik tanpa melalui pengadilan, atau sering disebut dengan pembatalan perjanjian secara sepihak. Adapun rumusan masalah dalam penelitian ini yaitu Bagaimana perlindungan hukum pihak pembeli yang beritikad baik atas pembatalan secara sepihak yang menimbulkan kerugian? Dan Bagaimana penerapan hukum dalam menentukan sah tidaknya suatu pembatalan perjanjian jual beli. Penelitian ini menggunakan metode yuridis normatif yang didukung yuridis empiris. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Disamping itu juga digunakan data primer sebagai pendukung bahan hukum data sekunder. Teori yang digunakan dalam penelitian ini yaitu teori keadilan dari Hans Kelsen dan teori perlindungan hukum dari Philipus M. Hadjon. Perlindungan hukum pihak pembeli yang beritikad baik atas pembatalan secara sepihak yang menimbulkan kerugian yaitu berupa perlindungan hukum represif dengan mengajukan gugatan kepada pihak penjual karena telah melakukan perbuatan melawan hukum dengan melakukan pembatalan akta PPJB secara sepihak tanpa melalui pengadilan, sehingga pihak pembeli yang beritikad baik memperoleh ganti rugi berupa pembayaran biaya karena telah dirugikan dan meniadakan sesuatu yang diadakan secara melawan hukum dan larangan untuk melakukan suatu perbuatan yaitu dengan membatalkan surat pembatalan PPJB pihak penjual sehingga pihak pembeki berhak melanjutkan pembayaran sebagaimana yang telah diperjanjikan dalam akta PPJB. / A trade and purchase agreement (PPJB) set forth in the Act is an authentic deed that has a perfect proof of proving strength. If the things that have been agreed upon in the binding deed of sale are violated or not fulfilled by the parties that make it then it can be said there has been a default. Article 1266 paragraph (2) the Civil Code states that to cancel a treaty shall be with the judgment of the judge. But in practice, although the sale and purchase agreement (PPJB) has had a perfect proof of power, there is still a cancellation made by one or no court through the courts, or often referred to as unilaterally canceled the agreement. The problem in this research is how is the legal protection of the buyer who has a good faith for the cancellation unilaterally caused losses? And how does the legal application in determining the validity of a cancellation of sale and purchase agreements. This research uses the normative juridical method that is supported by the empirical. The data used is secondary data consisting of primary legal material, secondary legal material and tertier legal materials. Besides, it also used primary data as a supporter of secondary data legal material. The theory used in this study was the theory of justice from Hans Kelsen and the legal protection theory of Philipus M. Hadjon. Legal protection of the buyer who is in good faith for the cancellation unilaterally caused a loss is the protection of the repressive law by filing a lawsuit against the seller because it has committed a deed against the law by cancelling the deed of PPJB unilaterally without going through the court, So that the buyer who is in good faith get compensation in the form of payment of fees because it has been harmed and negates something held against the law and the prohibition to do a deed is to cancel the cancellation letter of the vendor's PPJB so that the differentiation is entitled to continue payment as promised in the PPJB deed."
