Abstract

Setiap profesi hukum mempunyai kode etik profesi yang harus dilaksanakan dengan baik oleh pengemban profesi tersebut. Pengemban profesi Notaris harus melaksanakan kewajibannya dengan baik dan benar, sesuai dengan peraturan yang berlaku, salah satunya yaitu dengan hanya membuka atau mempunyai satu kantor. Majelis Pengawas Notaris mempunyai pengaruh yang cukup besar dalam hal penanggulangan pelanggaran ini. Hal yang menjadi permasalahan di masyarakat adalah Autentisitas produk hukum yang diterbitkan oleh Notaris, yaitu aktanya. Karena itu, dalam penelian ini akan dilakukan penelitian tentang Autentisitas akta Notaris yang mempunyai lebih dari satu kantor, dan tindakan Majelis Pengawas Notaris terhadap Notaris yang melakukan pelanggaran ini. Belum ada peraturan yang mengatur secara tegas dan jelas mengenai Autentisitas akta Notaris yang bersangkutan, karena itu kemungkinan dari Autentisitas akta Notaris yang bersangkutan ada dua, yaitu akta tersebut terdegradasi menjadi akta yang berkekuatan dibawah tangan atau batal demi hukum. Lalu bagi Notaris yang bersangkutan, dijatuhkan sanksi secara hierarkis oleh Majelis Pengawas Notaris. / Every law related profession have their ethics code which needs to be obeyed and performed competently by all the people who involved in that field. As a Notary, they have to do their obligation flawlessly, in accordance with the applicable regulation. For instance, as a Notary, they only allowed to open one notarial office. Notary Supervisory Council have enough power to overcome the violation of ethics code. The issue that arise in the society is about the legality of the legal product that being produce by the Notary, which is the deed. Therefore, this particular research will examine the legality of Notarial deed that made by a notary who is owning more than one notarial office, and the action from Notary Supervisory Council to respond this specific violation. Furthermore, up until now there is no clear and rigorous law that regulate the legality of Notarial deed by the concerned Notary. Thus, there are two possibility of Notarial Deed Legality. First, the deed being degraded to private deed or null and void by law. Then for the Notary concerned, will be given a sanction hierarchically by the Notary Supervisory Council.
